Colorado Safer-at-Home Order

The Governor issued a statewide Colorado Stay-at-Home Order (Public Health Order 20-24) effective March 26 until April 26, 2020, (extended from April 11th), (except for the listed critical activities essential to your health and safety) to minimize the spread of COVID-19 by reducing close contact with other people or contaminated air, papers, items or surfaces.

Maintain 6-feet social distancing from other people.  Do not shake hands, touch or hug when greeting.  Do not share pens.  Pay online with a credit card, not cash.  Wash your hands with soap and water for 20 seconds or use hand sanitizer after touching a contaminated item or surface.  Disinfect items and surfaces using EPA registered List N disinfectants according to label directions before touching.  Do not touch your face before disinfecting your hands.  Wear a face mask and disposable gloves. Remove and disinfect your shoes when you get home. Stay at home if you are coughing, sneezing, have a fever or feel sick, or if you have been exposed to a sick person or coronavirus contamination.

Notaries are not specifically listed in the Public Health Order details as providing one of the Critical Government Functions related to maintaining public health, safety or sanitation.  Gerald Lucas has a Colorado life and health insurance license .PDF. President Trump announced his 3-phase Guidelines for Opening Up America Again on April 16, 2020.  Governor Polis has announced that the Colorado Stay-at-Home order ended on April 26th.

Under the Colorado Safer-at-Home Order PDF, many listed “non-essential” businesses re-opened on Monday, April 27th, following infection prevention and control guidelines, with strict precautions and protections for nursing homes. Bars, restaurant dining rooms, and clubs are expected to remain closed until the middle of May. Retailers may offer curbside delivery starting April 27th, and then may reopen, with social distancing measures in place, on Friday, May 1st.  Dental offices, salons, tattoo shops, dog grooming, and other businesses offering personal services may reopen by following appropriate precautions and social distancing measures. Elective medical services and surgeries may begin again. Offices may reopen with 50 percent of the workforce starting Monday, May 4th.  Schools will remain closed to in-person instruction for the rest of the school year. Childcare centers may reopen with strict precautions.

Seniors over age 60 and vulnerable populations need to Stay at Home except when absolutely necessary, and need to use strict precautions and protections when leaving home.

The Governor extended the Colorado state of emergency for 30 more days on April 8th and monthly since then.  Many rural counties in Colorado have reported few or no cases of COVID-19.  Some Colorado cities and counties are following re-opening guidelines that differ from the Governor’s Safer-at-Home guidelines.

The Colorado General Assembly was on extended pandemic recess for two months. The legislative session resumed on Tuesday, May 26th. The legislature must deal with emergency issues and pass a balanced budget before July, despite a sharp drop in revenue due to business closures and stay at home executive orders during the pandemic.

Businesses are seeking temporary, legal, and regulatory safe harbor legislation to curb liabilities for employers who follow official health and safety guidelines if a business is interrupted or if employees or customers contract COVID-19 once operations resume.  OSHA is issuing new rules for worker infection protection.

Businesses are following guidelines for increased cleaning and disinfecting protocols. See McDonald\s restaurant cleaning and safety precautions. Some Starbucks cafes are open inside Safeway and King Soopers grocery stores. See Starbucks elevated cleaning and sanitizing protocols.

Dine-in restaurants in Colorado are allowed to re-open starting May 27, 2020, if infection control policies are followed including limiting customers to 50% of capacity, maximum indoor air ventilation, 6-foot table/party spacing, shared surfaces cleaned and disinfected between seatings, posted cleaning log, employees wearing masks, server hand washing every 30 minutes, single-use menus or menu board, no self-service stations or buffets, directional and spacing floor decals, hand sanitizer available, social distancing in waiting area, customers should wear masks when not eating or drinking, customers should register name to be notified of outbreak, bathroom cleaning every 60 minutes.

Governor Polis signed executive order D 2020 092 on June 4th, giving business owners discretion to deny admittance or service and require the removal of any individual who fails to wear a medical or non-medical face covering.  The order expires July 4th, unless extended.

Colorado Remote Notary Rule 5 Approved

On March 28, 2020, Governor Jared Polis signed an emergency Executive Order D 2020 019 PDF to temporarily suspend the requirement for a personal appearance before a notary and to allow remote notary service in Colorado using live two-way audio/video communication (remote A/V notary), On March 30th, the Secretary of State released Colorado SOS Notary Rule 5 for Remote Notarization PDF. This is a temporary emergency rule, not a statute passed by legislation. Authorization to perform Colorado remote notarization, set to expire on April 30th, was extended by the Secretary of State’s emergency rule on April 28th until May 30th. On April 6th, the Governor signed Executive Order D 2020 030 to extend remote notary service until April 30th.  On April 30th, he signed Executive Order D 2020 047 to extend remote notary service for 30 days until May 30th. On May 29th, he signed Executive Order D 2020 087, to extend remote notary service for 30 days until June 28th.

The notarial certificate must indicate that the notarial act was performed using audio-video technology.  Fannie Mae refers to this process as remote ink-signed notarization (RIN) since paper documents are signed with a pen.

COLORADO REMOTE NOTARY STATUS The executive order authorizing Colorado SOS emergency Rule 5 to allow remote notarization by video meeting was set to expire on June 28th.  On June 9th, the Colorado legislature approved new laws for Remote Online Notarization (RON) based on Senate Bill SB 20-96, Remote Notaries Protect Privacy, effective January 1, 2021.  Meanwhile, SOS Rule 5 is authorized by the new laws for interim use for the rest of 2020 until the new remote notary laws take effect.

Signers must be aware of the time and place of signing, coherent in conversation, not confused, able to communicate with the notary, answer questions, able to recognize family, friends, and associates, must understand the purpose of the document, may be required to take an oath or affirmation, and must sign voluntarily, not under undue influence, pressure, threat, coercion or duress. Please complete the document, except for signatures, and find witnesses, if needed, before we arrive, to avoid waiting time and extra charges.
