Determine if the <strong>primary purpose<\/strong> of the message is <strong>commercial content<\/strong>, to advertise or promote a commercial product or service,\u00a0<strong>transactional<\/strong> or <strong>relationship content<\/strong>, to update an existing customer, or other content.<br \/>\n2. Do not use false or deceptive header information<br \/>\n3. Do not send e-mail to recipients without written <strong>opt-in<\/strong> approval, as a best practice, double opt-in is the best method to prevent false sign-ups by pranksters<br \/>\n4.\u00a0Do not use blank or <strong>deceptive<\/strong> subject lines, the subject must describe message contents and may not include any sexually-oriented material<br \/>\n5. Identify the message as an <strong>advertisement<\/strong>, make the notice clear and conspicuous with large letters<br \/>\n6. Include the sender&#8217;s name and valid physical postal <strong>address<\/strong><br \/>\n7. remind the reader of the sign-up date and method, as a best practice<br \/>\n8. Include an easy, clear and conspicuous explanation of how to <strong>opt-out<\/strong> of receiving all or certain types of future messages<br \/>\n9. Honor opt-out requests promptly, within 10 business days<br \/>\n10. Monitor messages that are sent on your behalf by assistants and marketing agencies<br \/>\n11. Do not send a commercial message to a mobile service <strong>wireless device<\/strong> without express prior <strong>opt-in<\/strong> authorization<br \/>\n12. Check the process periodically to make sure it is working in compliance with the law,\u00a0opt-out must be functional<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Spam_Law_Penalties\"><\/span>Colorado Spam Law Penalties<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">An e-mail service provider (ESP), whose network was used to send spam, may file a <strong>civil action<\/strong> to recover <strong>damages<\/strong>, attorney fees, and costs.<\/p>\n<p style=\"text-align: justify;\">In addition, the e-mail service provider is entitled to recover <strong>statutory damages<\/strong> of <strong>$1,000<\/strong> for each spam e-mail sent, up to <strong>$10 million<\/strong> per occurrence.<\/p>\n<p style=\"text-align: justify;\">E-mail service providers that adopt and implement <strong>terms<\/strong>, <strong>conditions<\/strong> or technical measures to prevent or prohibit <strong>spam<\/strong> shall be <strong>immune<\/strong> from <strong>civil liability<\/strong> for actions of the spam sender.<\/p>\n<p style=\"text-align: justify;\">The <strong>Colorado spam law<\/strong> applies when spam e-mail is sent to a computer located in <strong>Colorado<\/strong> or to an e-mail address held by a <strong>Colorado resident<\/strong>.<\/p>\n<p style=\"text-align: justify;\">In addition to all other actions, remedies and <strong>penalties<\/strong> under state and federal law, the <strong>Colorado Attorney General<\/strong> is authorized to take all actions found in <strong>15 USC 7706<\/strong>(f), Enforcement by States,\u00a0to recover <strong>statutory damages<\/strong> of <strong>$250<\/strong> for each spam e-mail sent, up to <strong>$2 million<\/strong> per occurrence, plus attorney fees and costs. Triple damages may be awarded for willful, knowing, or aggravated violations, including address harvesting, spoofing, or automated creation of multiple e-mail accounts to send spam.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Reporting_Spam_in_Colorado\"><\/span>Reporting Spam in Colorado<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Consumers who receive spam e-mail may report it to the <strong>e-mail service provider<\/strong> of the recipient, such as:\u00a0 <span \n                data-original-string='pwvft92IQQ4rjmBowSf1QQ==ad7RttXTZVNKTngR5npPf+uig=='\n                class='apbct-email-encoder'\n                title='This contact has been encoded by Anti-Spam by CleanTalk.
