\"Colorado<\/a>Colorado Trademark Registration<\/h1>\n

Colorado<\/strong> allows trademark registration<\/strong> under state law, found at CRS 7-70-101<\/strong>.\u00a0 Registration under Colorado law is easier, faster and less expensive than federal trademark registration<\/strong>.<\/p>\n

A trademark<\/strong> is any word, name, slogan, symbol, device or any combination thereof, including packaging, configuration of goods, or other trade dress, adopted and used by a person to identify goods<\/strong> made or sold or services<\/strong> rendered, and to distinguish them from goods made or sold or services rendered by others.<\/p>\n

State trademark registration<\/strong> is used to help protect a trademark in the geographic area where it is used.\u00a0 It may be adequate for a small business with customers in a limited territory.<\/p>\n

Federal trademark registration,<\/strong> indicated with the symbol \u00ae<\/strong>, provides federal protection and more protection than state registration.\u00a0 But, federal registration can be a lengthy, expensive process.\u00a0 Filing a Colorado trademark registration does not protect it against a federal trademark.\u00a0 State registration does not authorize the use of the federal registration symbol \u00ae<\/strong>.<\/p>\n

Trademark rights<\/strong> are principally established under common law<\/strong> by first use in a given type of business, and actual and continuous use<\/strong> of the mark.\u00a0 Trademark registration under federal or state law is not required but has advantages.<\/p>\n

Standard Character or Special Form Trademark<\/h2>\n

A Colorado registration allows for a standard character trademark<\/strong> and a special form trademark<\/strong>.\u00a0 A standard character trademark<\/strong> is expressed in ordinary English letters, Roman and Arabic numbers, or punctuation, without any stylization.\u00a0 A special form trademark<\/strong> includes logos<\/strong>, pictures, design elements, color, or style of lettering.<\/p>\n

The registrant must state a good faith<\/strong> belief that the submitted trademark does not cause trademark infringement<\/strong> on any other trademark rights.<\/p>\n

Colorado registrations are effective for 5 years and may be renewed before expiration in successive 5-year terms.\u00a0 Prior to May 29, 2007, Colorado trademarks were effective and renewed for 10 years.<\/p>\n

To file a Colorado registration, submit a Statement of Registration of Trademark<\/strong> electronically, with the required attachments and filing fee.\u00a0 The electronic form is found on the Colorado Secretary of State<\/strong> (SOS) website at https:\/\/www.sos.state.co.us\/pubs\/business\/forms_main.html#Trademarks<\/a><\/strong><\/span>\u00a0 The current filing fee is $30.<\/p>\n

A class code<\/strong> is required, indicating the type of goods<\/strong> and services<\/strong> offered by the business. The class codes are found on the US Patent and Trademark Office<\/strong> (USPTO<\/strong>) website.<\/p>\n
