Records Affidavit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A <strong>blockchain records affidavit<\/strong> is used under state or <strong>Federal Rules of Evidence<\/strong>, Article VIII, <strong>Hearsay Rule 803(6)<\/strong>.<\/p>\n<p style=\"text-align: justify;\">An <strong>affidavit<\/strong>, with a blockchain record attached, sworn to by the digital <strong>record keeping custodian<\/strong> of a business, may be accepted as <strong>evidence<\/strong> in a court case. It is similar to a <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/business-records-affidavit\/\" target=\"_blank\" rel=\"noopener noreferrer\">business records affidavit<\/a><\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">Blockchain digital records are new technology. Laws and evidence rules need to be updated to readily accept them as admissible.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Vermont_Rule_of_Evidence_902_Blockchain_Records\"><\/span>Vermont Rule of Evidence 902, Blockchain Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-6868\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Vermont-outline.jpg\" alt=\"Vermont outline\" width=\"47\" height=\"80\" \/><strong>Vermont<\/strong> has passed a state law, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/081\/01913\" target=\"_blank\" rel=\"noopener noreferrer\">12 V.S.A. \u00a7 1913 Blockchain enabling<\/a><\/strong><\/span>, under Title 12, Court Procedure, that allows blockchain digital records as evidence, if a <strong>notarized affidavit<\/strong> is attached. The law states:<\/p>\n<p style=\"text-align: justify;\"><em>A digital record electronically registered in a blockchain shall be self-authenticating pursuant to Vermont Rule of Evidence 902, if it is accompanied by a written declaration of a qualified person, made under <strong>oath<\/strong>, stating the qualification of the person to make the certification and:<\/em><br \/>\n<em>(A) the date and time the record entered the blockchain;<\/em><br \/>\n<em>(B) the date and time the record was received from the blockchain;<\/em><br \/>\n<em>(C) that the record was maintained in the blockchain as a regular conducted activity; and<\/em><br \/>\n<em style=\"text-align: justify;\">(D) that the record was made by the regularly conducted activity as a regular practice<\/em><\/p>\n<p style=\"text-align: justify;\">&#8220;<strong>Blockchain<\/strong>&#8221; means a cryptographically secured, chronological, and <strong>decentralized<\/strong> consensus ledger or consensus database maintained via Internet, peer-to-peer network, or other interaction.<\/p>\n<p style=\"text-align: justify;\">&#8220;<strong>Blockchain technology<\/strong>&#8221; means computer software or hardware or collections of computer software or hardware, or both, that utilize or enable a blockchain.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Arizona_Electronic_Records\"><\/span>Arizona Electronic Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.azleg.gov\/ars\/44\/07061.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Arizona Revised Statutes, ARS 44-7061 B Blockchain records<\/a><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-6869\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Arizona-outline.jpg\" alt=\"Arizona outline\" width=\"68\" height=\"80\" \/>ARS 44-7061 B. A record or contract that is secured through blockchain technology is considered to be in an electronic form and to be an electronic record.<\/p>\n<p style=\"text-align: justify;\">&#8220;<strong>Blockchain technology<\/strong>&#8221; means distributed ledger technology that uses a distributed, decentralized, shared and replicated ledger, which may be public or private, permissioned or permissionless, or driven by tokenized crypto economics or tokenless. The data on the ledger is protected with cryptography, is immutable and auditable and provides an uncensored truth.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Nevada_Electronic_Records\"><\/span>Nevada Electronic Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.leg.state.nv.us\/NRS\/NRS-078.html#NRS078Sec0297\" target=\"_blank\" rel=\"noopener\">Nevada Revised Statutes, NRS 78.02971 Corporate records<\/a><\/strong><\/span><\/p>\n<p>NRS 78.02971 Corporate Records<br \/>\n1. Except as otherwise required by federal or state law, any records maintained by a corporation in its regular course of business, including, without limitation, its stock ledger, minute books, books of account and financial records, may be kept on, or by means of, any information processing system or other information storage device or medium, including, without limitation, a blockchain, or in the form of an electronic record.<\/p>\n<p>NRS\u2002719.045\u2002\u2002\u201cBlockchain\u201d defined.<br \/>\n1.\u2002\u2002\u201cBlockchain\u201d means an electronic record of transactions or other data which is:<br \/>\n(a)\u2002Uniformly ordered;<br \/>\n(b)\u2002Processed using a decentralized method by which one or more computers or machines verify the recorded transactions or other data;<br \/>\n(c)\u2002Redundantly maintained by one or more computers or machines to guarantee the consistency or nonrepudiation of the recorded transactions or other data; and<br \/>\n(d)\u2002Validated by the use of cryptography.<br \/>\n2.\u2002\u2002The term includes, without limitation, a public blockchain.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"South_Dakota_Electronic_Records\"><\/span>South Dakota Electronic Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/sdlegislature.gov\/Statutes\/Codified_Laws\/2072090\" target=\"_blank\" rel=\"noopener noreferrer\">South Dakota Code, SDC 53.12.1 (8) Electronic records<\/a><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">SDC 53-12 Electronic Transactions.<br \/>\n<span class=\"s2072090SENU\">53-12-1<\/span><span class=\"s2072090SENU\">.\u00a0<\/span><span class=\"s2072090CL\">Definition of terms.<br \/>\n(3) &#8220;<strong>Blockchain technology<\/strong>,&#8221; technology that uses a distributed, shared, and replicated ledger, either public or private, with or without permission, or driven with or without tokenized crypto economics where the data on the ledger is protected with cryptography and is immutable and auditable;<br \/>\n<\/span>(8) &#8220;Electronic record,&#8221; a record created, generated, sent, communicated, received, or stored by electronic means. (b) (same as Arizona) A record or contract that is secured through blockchain technology is considered to be in an electronic form and to be an electronic record.<\/p>\n<p style=\"text-align: justify;\">TCA 47-10-201. (1) &#8220;<strong>Blockchain technology<\/strong>&#8221; (same as Arizona) means distributed ledger technology that uses a distributed, decentralized, shared, and replicated ledger, which may be public or private, permissioned or permissionless, or driven by tokenized crypto economics or tokenless.\u00a0 The data on the ledger is protected with cryptography, is immutable and auditable, and provides an uncensored truth.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Ohio_Uniform_Commercial_Code_UCC_Uniform_Electronic_Transactions_Act\"><\/span>Ohio Uniform Commercial Code (UCC), Uniform Electronic Transactions Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/codes.ohio.gov\/orc\/1306\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-6870\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Ohio-outline.jpg\" alt=\"Ohio outline\" width=\"78\" height=\"80\" \/>Ohio ORC 1306.01 Definitions<\/a><\/span><\/strong> (G) &#8220;Electronic record&#8221; means a record created, generated, sent, communicated, received, or stored by electronic means. A record or contract that is secured through <strong>blockchain technology<\/strong> is considered to be in an electronic form and to be an electronic record.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Delaware_General_Corporation_Law_Electronic_Records\"><\/span>Delaware General Corporation Law, Electronic Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/delcode.delaware.gov\/title8\/c001\/sc07\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-6874\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Delaware-outline.jpg\" alt=\"Delaware outline\" width=\"44\" height=\"80\" \/>Delaware Code, Title 8 Chapter 1 Subchapter 7 \u00a7 224 Form of records.<\/a><\/strong><\/span> When electronic records are kept, a clearly legible paper form prepared from or by means of the information storage device, method, or 1 or more electronic networks or databases (including 1 or more distributed electronic networks or databases) shall be valid and admissible in <strong>evidence<\/strong>, and accepted for all other purposes, to the same extent as an original paper record of the same information would have been, provided the paper form accurately portrays the record.<\/p>\n<p style=\"text-align: justify;\">Other states may follow with similar laws or rules of evidence to allow the use of record-keeping using blockchain <strong>distributed ledger technology<\/strong> (DLT).<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Federal_Rule_of_Evidence_FRE_8036_Business_Records_Exception_to_the_Rule_Against_Hearsay\"><\/span>Federal Rule of Evidence (FRE) 803(6), Business Records Exception to the Rule Against Hearsay<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">There is a potential <strong>hearsay<\/strong> barrier to the introduction of any evidence from a blockchain distributed ledger.\u00a0 A <strong>blockchain receipt<\/strong> will generally be admissible as a <strong>business records exception<\/strong> if it meets the requirements of <span style=\"text-decoration: underline;\"><strong><a title=\"Federal Rule of Evidence 803(6)\" href=\"https:\/\/www.law.cornell.edu\/rules\/fre\/rule_803\" target=\"_blank\" rel=\"noopener noreferrer\">Federal Rule of Evidence 803(6)<\/a><\/strong><\/span>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Federal_Rule_of_Evidence_FRE_902_Evidence_That_Is_Self-Authenticating\"><\/span><img decoding=\"async\"  class=\"alignleft wp-image-1946 size-thumbnail\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/CO-Supreme-Court-scales-240x240-150x150.jpg\" alt=\"CO Supreme Court scales\" width=\"100\" height=\"100\" \/>Federal Rule of Evidence (FRE) 902, Evidence That Is Self-Authenticating<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Amendments 13 and 14 to <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.law.cornell.edu\/rules\/fre\/rule_902\" target=\"_blank\" rel=\"noopener noreferrer\">FRE 902<\/a><\/strong><\/span>, which took effect in December 2017, permit <strong>self-authentication<\/strong> of much digital evidence.<\/p>\n<p style=\"text-align: justify;\"><b>(11) Certified Domestic Records of a Regularly Conducted Activity.<\/b> The original or a copy of a domestic record that meets the requirements of Rule 803(6)(A)-(C), as shown by a certification of the <strong>custodian<\/strong> or another qualified person that complies with a federal statute or a rule prescribed by the Supreme Court.<\/p>\n<p class=\"statutory-body-1em\" style=\"text-align: justify;\"><strong>(13) Certified Records Generated by an Electronic Process or System.\u00a0<\/strong>A record generated by an electronic process or system that produces an accurate result, as shown by a certification of a qualified person that complies with the certification requirements of Rule 902(11) or (12). The proponent must also meet the notice requirements of Rule 902(11).<\/p>\n<p class=\"statutory-body-1em\" style=\"text-align: justify;\"><strong>(14) Certified Data Copied from an Electronic Device, Storage Medium, or File. <\/strong>Data copied from an electronic device, storage medium, or file if authenticated by a process of digital identification, as shown by a certification of a qualified person that complies with the certification requirements of Rule 902(11) or (12). The proponent also must meet the notice requirements of Rule 902 (11).<\/p>\n<p style=\"text-align: justify;\">The Committee Notes for FRE 902 Amendment 14 state:<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;Today, data copied from electronic devices, storage media, and electronic files are ordinarily authenticated by &#8220;<strong>hash value<\/strong>&#8220;. A hash value is a number that is often represented as a sequence of characters and is produced by an algorithm based upon the digital contents of a drive, medium, or file. If the hash values for the original and copy are different, then the copy is not identical to the original. If the hash values for the original and copy are the same, it is highly improbable that the original and copy are not identical. Thus, identical hash values for the original and copy reliably attest to the fact that they are exact duplicates. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>This amendment allows self-authentication by a certification of a qualified person that she checked the hash value of the proffered item and that it was identical to the original.
