justify;\">In <strong>trademark infringement<\/strong> cases, courts look at several factors to determine if a <strong>likelihood of confusion<\/strong> may exist.<\/p>\n<p style=\"text-align: justify;\">1.\u00a0 Similarity of the two marks<br \/>\n2.\u00a0 Strength of the mark<br \/>\n3.\u00a0 Marketing channels used<br \/>\n4.\u00a0 Evidence of actual consumer confusion<br \/>\n5.\u00a0 Intent of the defendant in using a mark<br \/>\n6.\u00a0 Proximity of products or services<br \/>\n7.\u00a0 Similarity in the goods and services offered<br \/>\n8.\u00a0 Degree of care likely to be exercised by the consumer<br \/>\n9.\u00a0 Likelihood of expansion of product or service line<\/p>\n<p style=\"text-align: justify;\">The same mark may be used by two companies in the same area that provide different, <strong>unrelated services<\/strong>, such as Acme Plumbing and Acme Towing.\u00a0\u00a0 But, there may be <strong>confusion<\/strong> between similar services such as Acme Plumbing and Acme Drain Cleaning.<\/p>\n<p style=\"text-align: justify;\">A word or <strong>logo<\/strong> must be <strong>distinctive<\/strong> to be considered a <strong>trademark<\/strong> or <strong>service mark<\/strong>.\u00a0 <strong>Fanciful marks<\/strong> and arbitrary marks are the strongest type of marks and are used for the sole purpose of serving as a trademark.\u00a0 Weaker types of marks are suggestive, descriptive, surname, and generic.<\/p>\n<p style=\"text-align: justify;\">A <strong>trademark<\/strong>, denoted by the symbol <strong>&#x2122;<\/strong>, or a <strong>service mark<\/strong>\u00a0<strong>\u2120<\/strong>, may be established under <strong>common law<\/strong> by regular use.\u00a0 A trademark may also be federally <strong>registered<\/strong> with the <strong><a href=\"https:\/\/www.uspto.gov\/trademark\" target=\"_blank\" rel=\"noopener noreferrer\">US Patent and Trademark Office<\/a> (USPTO)<\/strong>,\u00a0denoted by the symbol\u00a0<strong>\u00ae, <\/strong>or registered under state law.<\/p>\n<p style=\"text-align: justify;\">Trademark owners may do an internet search to find <strong>trademark infringement<\/strong> due to the <strong>unauthorized use<\/strong> of a company <strong>logo<\/strong>.\u00a0 A computer repair shop, displaying a logo for Apple, Dell, Microsoft, or Hewlett-Packard, might be engaging in a manner intended to confuse or deceive the public that the repair shop was <strong>affiliated<\/strong>, <strong>approved,<\/strong> <strong>authorized, certified,<\/strong> or<strong> endorsed<\/strong> by a well-known major corporation.<\/p>\n<p style=\"text-align: justify;\">A computer retailer might use a computer manufacturer&#8217;s <strong>logo<\/strong> in sales ads, as an <strong>authorized retailer<\/strong>.\u00a0 Comparative advertising between similar products may be acceptable use.<\/p>\n<p style=\"text-align: justify;\">Another <strong>fair use<\/strong> might be a technology magazine, doing a tech review on new computer products.\u00a0 The magazine is in the publishing business, not computer manufacturing.<\/p>\n<h2 style=\"text-align: justify;\"><span
