class=\"ez-toc-section-end\"><\/span><\/h1>\n<p style=\"text-align: justify;\">Colorado law CRS 6-1-716 requires notice to consumers of a <strong>data security breach<\/strong>.\u00a0 It is part <a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2013\/11\/ABC_logo_180x180-e1426906942367.jpg\"><img decoding=\"async\"  class=\"size-full wp-image-160 alignleft\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2013\/11\/ABC_logo_180x180-e1426906942367.jpg\" alt=\"ABC Legal Docs logo\" width=\"150\" height=\"150\" \/><\/a>of the <strong>Colorado Consumer Protection Act<\/strong>.<\/p>\n<p style=\"text-align: justify;\">A <strong>data security breach<\/strong> occurs when there is an <strong>unauthorized acquisition<\/strong> of <strong>unencrypted computerized data<\/strong> that compromises the security, confidentiality or integrity of <strong>personal information<\/strong>, maintained by an individual or a commercial entity, including a not-for-profit entity.<!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Data_Security_Breach_Notification_Methods\"><\/span>Data Security Breach Notification Methods<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Notification<\/strong> of a <strong>data security breach<\/strong> can be made by:<br \/>\n1.\u00a0 written notice to the postal address on record<br \/>\n2.\u00a0 telephone notice<br \/>\n3.\u00a0 electronic notice, or<br \/>\n4.\u00a0 substitute notice, if the cost of providing the notice will exceed $250,000.<\/p>\n<p style=\"text-align: justify;\"><strong>Substitute notice<\/strong> consists of all of the following:<br \/>\n1.\u00a0 E-mail notice, if the e-mail address is known<br \/>\n2.\u00a0 Conspicuous posting of the notice on a website of the recordkeeper, if one exists<br \/>\n3.\u00a0 Notification to major statewide media<\/p>\n<p style=\"text-align: justify;\"><strong>Personal information<\/strong> means a Colorado resident&#8217;s <strong>first name<\/strong> or first initial and <strong>last name<\/strong>, in combination with one or more of the following <strong>data elements<\/strong>, when the data elements are <strong>not encrypted<\/strong>, redacted or secured by any other method to make the data element unreadable or unusable.<\/p>\n<p style=\"text-align: justify;\">1.\u00a0 <strong>Social security number<\/strong><br \/>\n2.\u00a0 <strong>Driver&#8217;s license number<\/strong> or identification card number<br \/>\n3.\u00a0 <strong>Account number<\/strong>, <strong>credit card number<\/strong> or <strong>debit card number<\/strong>, in combination with any <strong>security code<\/strong>, access code or <strong>password<\/strong> that would permit access to a resident&#8217;s <strong>financial account<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Personal information<\/strong> does not include <strong>publicly available information<\/strong> that is lawfully made available from government records or widely distributed media.<\/p>\n<p style=\"text-align: justify;\">When the recordkeeper becomes aware of a <strong>data security breach<\/strong>, the recordkeeper shall conduct a prompt <strong>investigation<\/strong> to determine the likelihood that <strong>personal information<\/strong> has been or will be <strong>misused<\/strong>.\u00a0 <strong>Notice<\/strong> must be given to a Colorado resident as soon as possible, consistent with legitimate needs of <strong>law enforcement<\/strong>, and time needed to determine the scope of the data breach and to restore reasonable <strong>integrity<\/strong> of the data system.<\/p>\n<p style=\"text-align: justify;\"><strong>Notice<\/strong> may be delayed if a <strong>law enforcement<\/strong> agency determines that the notice will impede a <strong>criminal investigation<\/strong> and has notified the recordkeeper not to send the notice until a later date.<\/p>\n<p style=\"text-align: justify;\">A <strong>Written Information Security Policy<\/strong> (<strong>WISP<\/strong>) including its own notification procedures regarding a <strong>data security breach<\/strong>, shall be deemed to be in compliance with this section if the procedures are otherwise consistent with the timing requirements of this section.<\/p>\n<p style=\"text-align: justify;\">The <strong>Colorado Attorney General<\/strong> may initiate legal action to address <strong>violations<\/strong> of this section, including the recovery of direct <strong>economic damages<\/strong> resulting from a violation.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Use_Encryption_not_Plain_Text_Data\"><\/span>Use Encryption not Plain Text Data<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Tip<\/strong>: Note that if data is kept in <strong>encrypted<\/strong> form, if there is a data breach, notification is not required by law.\u00a0 Storing data in <strong>plain text<\/strong> format is not recommended due to increased risk of <strong>data theft<\/strong> in a <strong>data security breach<\/strong>.\u00a0 The <strong>encryption key<\/strong> should be stored in a secure location.\u00a0 If <strong>personal information<\/strong> is not needed, do not collect it or store
