CRS 15-11-502(2)<\/li>\n<li>A <strong>witnessed will<\/strong> requires the signer (<strong>testator<\/strong>) and two or more witnesses to sign, but no notary is required. CRS 15-11-502(1)(c)(I)<\/li>\n<li>A <strong>self-proving will<\/strong> requires the signer (testator) and two witnesses to <strong>appear before a notary<\/strong> and make a sworn statement (<strong>affidavit<\/strong>) that the will was signed voluntarily, the signer was at least 18 years of age, of sound mind, understood the purpose of the document, and was not under any constraint or undue influence.\u00a0CRS 15-11-504<\/li>\n<li>A <strong>notarized will<\/strong> requires the signer to <strong>appear before a notary<\/strong> and make an acknowledgment that he\/she understood the purpose of the document and signed voluntarily.\u00a0 No witnesses are needed.\u00a0CRS 15-11-502(1)(c)(II)<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">The advantage of using a notary is that the notary verifies the ID of the signer and any witnesses, takes a sworn statement or acknowledgment as required, dates and stamps the document with a <strong>notary seal<\/strong>, and records the document signing in the notary journal, providing <strong>notarial evidence<\/strong> of the transaction.<\/p>\n<p style=\"text-align: justify;\">A self-proving Colorado will can speed up the probate process, since it includes a sworn affidavit of the witnesses as evidence.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Legal_Forms\"><\/span>Colorado Legal Forms<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Be careful, state laws vary.\u00a0 If you use a <strong>do-it-yourself<\/strong> <span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/legal-forms\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>will legal form<\/strong><\/a><\/span>, make sure it follows your current state laws.\u00a0 Always check your state laws or with a\u00a0knowledgeable attorney for the correct procedure for signing, witnessing or notarizing a Colorado will or in any other state.<\/p>\n<p style=\"text-align: justify;\">Some wills refer to a separate\u00a0<span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/legal-forms\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Tangible Personal Property Letter<\/strong><\/a><\/span> or Memorandum, for giving specific items to a beneficiary.<\/p>\n<p style=\"text-align: justify;\">Note: A male signer of a will is known as a <strong>testator<\/strong>.
