{"id":571,"date":"2014-12-16T09:24:37","date_gmt":"2014-12-16T16:24:37","guid":{"rendered":"http:\/\/abclegaldocs.com\/blog-Colorado-Notary\/?p=571"},"modified":"2019-07-17T20:43:19","modified_gmt":"2019-07-18T02:43:19","slug":"impersonation-of-notary","status":"publish","type":"post","link":"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/impersonation-of-notary\/","title":{"rendered":"Impersonation of Notary"},"content":{"rendered":"<h1 style=\"text-align: justify;\">Impersonation of Notary<\/h1>\n<p style=\"text-align: justify;\"><strong>Colorado notary law<\/strong> CRS 12-55-117 defines <strong>willful impersonation<\/strong> of a <strong>notary<\/strong>.\u00a0 Any person who acts as, or otherwise willfully impersonates, a <a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\"><img decoding=\"async\"  class=\"alignleft wp-image-204 size-full\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\" alt=\"Colorado Notary Law\" width=\"120\" height=\"80\" \/><\/a>notary public, while <strong>not lawfully appointed<\/strong> and <strong>commissioned<\/strong> to perform notarial acts, is <strong>guilty<\/strong> of a class 2 <strong>misdemeanor<\/strong>.<\/p>\n<p style=\"text-align: justify;\">This applies to <strong>criminals<\/strong> using <strong>notary<\/strong>\u00a0<strong>impersonation<\/strong> to commit forgery or fraud, but it may also apply in other situations.<!--more--><\/p>\n<p style=\"text-align: justify;\">If a <strong>notary employee<\/strong> is gone on vacation or is off duty, no one else may use the notary&#8217;s stamp to notarize a document while the notary is gone.\u00a0 The notary must keep the notary stamp and journal secure.<\/p>\n<p style=\"text-align: justify;\">A notary should also be careful to check the <strong>expiration date<\/strong> of his\/her commission.\u00a0 The notary must not perform a <strong>notarial act<\/strong> after the <strong>expiration date<\/strong>, or if the notary commission has been <strong>suspended<\/strong> or <strong>revoked<\/strong>, or if the notary is no longer <strong>qualified<\/strong> to be a notary.<\/p>\n<h2 style=\"text-align: justify;\">Unauthorized Oath of Office<\/h2>\n<p style=\"text-align: justify;\">Notaries are authorized to administer <strong>oaths<\/strong> and <strong>affirmations<\/strong>, for written documents, or for witness testimony, or for <strong>oaths of office<\/strong> for elected or appointed officials.<\/p>\n<p style=\"text-align: justify;\">Many organizations, such as a Homeowners Association (<strong>HOA<\/strong>), non-profit, or a for-profit business, or a club, elect or appoint officers.\u00a0 Some organizations hold annual elections, annual meetings or installation dinners where newly elected officers take their <strong>oaths of office<\/strong>.<\/p>\n<p style=\"text-align: justify;\">According to Colorado law, only certain <strong>public officials<\/strong>, including notaries, have the <strong>legal<\/strong> <strong>authority<\/strong> to administer an oath or affirmation.\u00a0 So, a person who is not a notary, should not administer an oath of office.\u00a0 An oath of office, administered by a non-authorized person, might be challenged or impersonation.\u00a0 A non-authorized person must not perform <strong>notarial acts<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Notaries may purchase notary <strong>errors and omissions<\/strong> (E&amp;O) <strong>insurance<\/strong> to protect against mistakes.\u00a0 However, willful, illegal acts are not covered by insurance.<\/p>\n<p style=\"text-align: justify;\">Visit our website for <a href=\"https:\/\/abclegaldocs.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Colorado Springs Mobile Notary<\/strong><\/a> services or <a href=\"https:\/\/abclegaldocs.com\/Colorado_Notary_Training.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Colorado Notary Training<\/strong><\/a> classes.<\/p>\n<p style=\"text-align: justify;\">\u00a9 Copyright 2014\u00a0 ABC Legal Docs, LLC\u00a0 All rights reserved.\u00a0 Do not copy.\u00a0 Citations welcome.\u00a0 Terms of Use apply.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Impersonation of Notary Colorado notary law CRS 12-55-117 defines willful impersonation of a notary.\u00a0 Any person who acts as, or otherwise willfully impersonates, a notary public, while not lawfully appointed and commissioned to perform notarial acts, is guilty of a class 2 misdemeanor.
