\"Cicero<\/a>Roman Law Influence on Notaries, Tiro 50 BC<\/h1>\n

Roman Law<\/strong> affects civil law notaries in many countries.<\/p>\n

In ancient Rome<\/strong>, Marcus Tullius Tiro<\/strong> (103 BC-4 BC), initially a slave and then a freedman secretary of famed orator Marcus Tullius Cicero<\/strong> (106 BC-43 BC), is often regarded as the first notary<\/strong>.<\/p>\n

[Rome<\/strong>, the TV series (available on Amazon.com\u00ae), set in the first century BC, ran for two seasons on HBO\u00ae and includes Cicero<\/strong> and Tiro<\/strong> as characters in several episodes.]<\/p>\n

Tiro<\/strong> developed a shorthand<\/strong> writing system, known as nota<\/strong>, to record Cicero<\/strong>‘s speeches.\u00a0 Marks and signs were substituted for common words. The word notary<\/strong> comes from the Latin words Notae Tironinae<\/strong> or nota<\/strong>.<\/p>\n

Other literate people who wrote, recorded and witnessed documents for a fee, adopted the nota<\/strong> method, and the term notarius<\/strong> was used to describe them.\u00a0 Literacy was not widespread among the general population.<\/p>\n

Notaries<\/strong> became semi-officials during the early days of the Roman Empire<\/strong>.\u00a0 They were also officers of the Catholic Church<\/a><\/strong><\/span>, and Popes<\/strong> appointed papal notaries<\/strong>.\u00a0 The Roman Empire reached its peak during the second century.\u00a0 As the empire grew and literacy increased, the use of notaries<\/strong> spread throughout the empire.\u00a0 With the decline of the Roman Empire<\/strong>, the Pope<\/strong> and the Church<\/strong> took over many functions neglected by the Roman government.<\/p>\n

Notarios<\/h2>\n

After Columbus<\/a><\/strong><\/span> arrived in 1492, Spanish<\/strong> and French<\/strong> explorers came to the New World<\/strong> and brought their laws with them, which are based on Roman Law<\/strong>.\u00a0 Notaries in Spanish-speaking countries in Latin America<\/strong> are known as notarios<\/strong> and have more legal training and authority than notaries public in the United States.<\/p>\n

The British<\/strong> colonists<\/strong> and Pilgrims<\/strong> brought English law<\/strong>, which developed separately from Roman Law<\/strong>.\u00a0 In the United States today, 49 states have laws based on English common law<\/a><\/strong><\/span>. But, the laws of Louisiana<\/a><\/strong><\/span>, based on French law<\/strong>, and Puerto Rico<\/a><\/strong><\/span>, based on Spanish law<\/strong>, trace back to Roman law<\/strong>.<\/p>\n

For a while, Dutch colonial notaries<\/strong> in New Netherland<\/a><\/strong><\/span> and New Amsterdam<\/strong> (now New York<\/strong>), followed Dutch law<\/strong>, also derived from Roman law<\/strong>.\u00a0 The colony of New Sweden<\/a><\/strong><\/span>, on the Delaware River<\/strong>, followed Swedish Law<\/strong>, based on Roman law<\/strong>.\u00a0 The U.S. Virgin Islands<\/a><\/strong><\/span>, formerly known as the Danish West Indies<\/strong>, were purchased from Denmark<\/strong> in 1917, and also followed Roman law<\/strong>.<\/p>\n

Current day Colorado<\/strong>, formed in 1861, was under the influence of Roman law<\/strong> for over one hundred twenty years, when eastern Colorado was part of Louisiana Territory (New France)<\/strong>.\u00a0 From 1682, when explorer La Salle<\/a><\/strong><\/span> claimed the land for France<\/strong>, until the Louisiana Purchase<\/strong> by Thomas Jefferson<\/strong> in 1803, the French<\/strong> and Spanish<\/strong> alternated ownership of Louisiana Territory<\/strong>.<\/p>\n

The influence of Roman law<\/strong> spread far and wide and has lasted for centuries in some countries.<\/p>\n
