{"id":550,"date":"2014-12-12T18:45:11","date_gmt":"2014-12-13T01:45:11","guid":{"rendered":"http:\/\/abclegaldocs.com\/blog-Colorado-Notary\/?p=550"},"modified":"2019-07-17T21:47:14","modified_gmt":"2019-07-18T03:47:14","slug":"colorado-notary-rule-changes","status":"publish","type":"post","link":"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/colorado-notary-rule-changes\/","title":{"rendered":"Colorado Notary Rule Changes"},"content":{"rendered":"<h1 style=\"text-align: justify;\">Colorado Notary Rule Changes<\/h1>\n<p style=\"text-align: justify;\">Several changes to <strong>Colorado Notary Rules<\/strong> became effective on November 30, 2014.\u00a0 Colorado notaries must follow <strong>Colorado notary laws<\/strong>, written by the state legislature, and <strong>notary rules<\/strong>, promulgated by <a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-204\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\" alt=\"Colorado Notary Law\" width=\"120\" height=\"80\" \/><\/a>the <strong>Secretary of State<\/strong> (SOS), the notary regulator.<\/p>\n<p style=\"text-align: justify;\">When state laws and notary rules are silent on a topic, notaries should use <strong>reasonable care<\/strong>, and follow <strong>common law<\/strong> and notary <strong>best practices<\/strong>.\u00a0 The <strong>Model Notary Act<\/strong> of 2010, published by the <strong>National Notary Association<\/strong>, contains notary <strong>best practices<\/strong>.<!--more--><\/p>\n<p style=\"text-align: justify;\">Notary rule changes include repeals of prior definitions of &#8220;<strong>best practices<\/strong>&#8220;, &#8220;renewing applicant&#8221; and &#8220;notary&#8217;s electronic signature&#8221;.\u00a0 Clarifications and amendments were made to the definitions of &#8220;new applicant&#8221;, &#8220;<strong>Document Authentication Number<\/strong>&#8220;, and &#8220;<strong>electronic notarization<\/strong>&#8220;.<\/p>\n<p style=\"text-align: justify;\">All notary filings are required to be submitted using the SOS online filing system.\u00a0 Questions on the <strong>notary exam<\/strong> will be based on the <strong>Colorado Notaries Public Act<\/strong> (CRS 12-55), Titles and Interests (CRS 38-30), <strong>Initiatives<\/strong> and <strong>Referendum<\/strong> (CRS 1-40) and the SOS <strong>Notary Handbook<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Several rules regarding <strong>electronic notarization<\/strong> were changed.\u00a0 <strong>Electronic notaries<\/strong> should read the new rules for electronic notarization (<strong>e-notarization<\/strong>) and <strong>electronic signatures<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Notary training rules clarify that &#8220;widely accepted <strong>best practices<\/strong>&#8221;
