This <strong>duty<\/strong> shall exist notwithstanding any other provision of the law to the contrary; except that this section shall not require disclosure of any <strong>communication privileged<\/strong> by law.<\/em><\/p>\n<p><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Notary_Duty_to_Report_a_Crime\"><\/span><strong>Notary Duty to Report a Crime<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Before, during or after a conversation, meeting or transaction, a <strong>notary<\/strong> may become aware of an actual, attempted or suspected <strong>crime<\/strong> such as <strong>fraud<\/strong>, forgery, identity theft, perjury, elder abuse, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/bribery-corrupt-influence-notary-public\/\" target=\"_blank\" rel=\"noopener noreferrer\">bribery<\/a><\/strong><\/span>, obstructing, threatening, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/bribery-corrupt-influence-notary-public\/\" target=\"_blank\" rel=\"noopener noreferrer\">influencing<\/a><\/strong><\/span> or assaulting a public official, disorderly conduct, harassment or other unlawful or illegal act.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-793\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Constitution-We-the-People_150x150.jpg\" alt=\"Constitution We the People\" width=\"150\" height=\"150\" \/>A notary is required to know and follow notary laws, and is not required to know all laws. But, a notary can look up Colorado laws or federal laws on the Internet or consult with an <strong>attorney<\/strong> for legal questions or <strong>legal advice<\/strong>.<\/p>\n<p style=\"text-align: justify;\">In many states, a notary takes an oath to support and defend the <strong>U.S. Constitution<\/strong> and the state Constitution. The notary should know the Constitution, especially the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/u-s-constitution-bill-of-rights\/\" target=\"_blank\" rel=\"noopener noreferrer\">Bill of Rights<\/a><\/strong><\/span>, and report violations.<\/p>\n<p style=\"text-align: justify;\">If a notary has <strong>evidence<\/strong> and reasonable grounds to believe a crime has been committed, the notary has a duty to report a crime to law enforcement. An alert notary will gather and report evidence to law enforcement, such as a suspect description, vehicle description and license plate number. A notary journal may contain additional information, including a suspect&#8217;s ID number, signature and thumbprint.<\/p>\n<p style=\"text-align: justify;\">A notary may complete an <strong>incident report<\/strong>\u00a0in the normal course of business for any type of disruptive, unusual, suspicious, threatening, unlawful or illegal act, security breach or rule violation. An incident report may be in the form of a notarized <strong>incident report\u00a0affidavit<\/strong> or attached to a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/business-records-affidavit\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>business records affidavit<\/strong><\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">The incident report should be completed promptly, before important details are forgotten. In some cases, the notary may have an audio or video recording or photo as evidence, or other witnesses.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"False_Reporting\"><\/span><img decoding=\"async\"  class=\"alignleft size-full wp-image-5341\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/true-false.jpg\" alt=\"true false\" width=\"150\" height=\"100\" \/>False Reporting<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The notary should use <strong>reasonable care<\/strong> to make a report in <strong>good faith<\/strong>, and not negligently or deliberately make a <strong>false report<\/strong>\u00a0(CRS 18-8-111) accusing a person of a crime or committing\u00a0<strong>slander<\/strong> or <strong>libel<\/strong> of a person&#8217;s reputation.<\/p>\n<p style=\"text-align: justify;\">A person might request a notary to perform an unlawful act due to ignorance or misunderstanding of the law or confusion about the role of the notary.
