href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\"><img decoding=\"async\"  class=\"alignleft wp-image-204 size-full\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\" alt=\"Colorado Notary Law\" width=\"120\" height=\"80\" \/><\/a>Colorado notaries are commissioned and regulated by the <strong>Colorado Secretary of State<\/strong> (SOS).\u00a0 The SOS is authorized to promulgate <strong>rules<\/strong> and publish information, including the Colorado Notary Handbook, to help notaries <strong>administer<\/strong> the notary laws.<!--more--><\/p>\n<p style=\"text-align: justify;\">It states the <strong>purpose<\/strong> of the handbook is to help familiarize notaries with Colorado Notary Law so that they can perform their duties correctly. \u00a0 By acting as an <strong>agent<\/strong> of the state, notaries help to prevent <strong>fraud<\/strong> and <strong>forgery<\/strong>.\u00a0 Notaries should perform their duties in a manner that merits the <strong>trust<\/strong>, <strong>confidence<\/strong>\u00a0and <strong>respect<\/strong> appropriate to the office.<\/p>\n<p style=\"text-align: justify;\">The <strong>Colorado Notary Handbook<\/strong> is merely a guide to <strong>best practices<\/strong>.\u00a0 The <strong>Colorado Notaries Public Act<\/strong>, upon which the handbook is based, is an evolving body of law both in form and meaning.\u00a0 All incongruities between the Notary Handbook and the <strong>statutes<\/strong> will be decided in favor of the statutes.\u00a0 Notaries are responsible for keeping themselves apprised of <strong>changes in the law<\/strong> that may affect the manner in which they perform notarizations.<\/p>\n<p style=\"text-align: justify;\">It includes procedures for administering an <strong>oath<\/strong> or <strong>affirmation<\/strong>, taking an <strong>acknowledgment<\/strong> and making a <strong>certified copy<\/strong>.\u00a0 It discusses the importance of watching for signs of <strong>duress<\/strong> or <strong>coercion<\/strong>, where the signer is not signing voluntarily, of his\/her own free will.<\/p>\n<p style=\"text-align: justify;\">It reminds notaries that their <strong>role<\/strong> is that of a <strong>public official<\/strong> and <strong>disinterested witness<\/strong>, and not as a doctor, lawyer, advisor, law enforcement officer, etc.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Protest_and_Notice_of_Dishonor\"><\/span>Protest and Notice of Dishonor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">It discusses the rarely used notary power to present and give <strong>notice of dishonor<\/strong> and to <strong>protest<\/strong> notes and other <strong>negotiable instruments<\/strong>, but only in accord with specific sections of the <strong>Uniform Commercial Code<\/strong> (UCC).<\/p>\n<p style=\"text-align: justify;\">Due to complexity, this notary power should not be used without special training and knowledge.\u00a0 Notaries are cautioned to be aware of potentially <strong>fraudulent<\/strong> or illegal <strong>protests<\/strong>, usually regarding <strong>debts<\/strong>.\u00a0 <strong>Protests<\/strong> for <strong>debt collection<\/strong> were common among <strong>Colonial notaries<\/strong>, but have faded into history with the modern use of computers.<\/p>\n<p style=\"text-align: justify;\">Colorado <strong>notary law<\/strong> once had a requirement for the <strong>notary\u2019s address<\/strong> on most notarial certificates.\u00a0 This requirement is long gone, but a notary may still encounter a preprinted notarial certificate with <strong>blank spaces<\/strong> for the notary\u2019s address.<\/p>\n<p style=\"text-align: justify;\">A notary is <strong>not required<\/strong> to put information in those blanks.\u00a0 He\/she can simply line or \u201cX\u201d through them.\u00a0 For the customer\u2019s comfort, however, the notary may wish to fill them in.\u00a0 For this purpose, if the notary prefers not to have his\/her <strong>home address<\/strong> shown to everyone who may see the document, the notary may use a <strong>business address<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Preprinted notarial certificates may include a space for the notary&#8217;s <strong>commission expiration date<\/strong>.\u00a0 The Notary Handbook instructs that this date may be filled in, even though it appears on the <strong>notary stamp<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The Colorado Notary Handbook concludes with a discussion on <strong>electronic notarization<\/strong> and <strong>electronic signatures<\/strong>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"New_Colorado_Notary_Handbook_March_2019\"><\/span>New Colorado Notary Handbook, March 2019<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Colorado Secretary of State has released a new version of the 38-page Colorado Notary Handbook, dated March 25, 2019. The previous version was dated January 18, 2018.<\/p>\n<p style=\"text-align: justify;\">I found no announcement about the new handbook on the SOS website and no description of the changes.
