They were often called on to take a sea protest or <strong>marine protest<\/strong> made by vessel-masters (captains) or by merchants who shipped goods or chartered vessels. The <strong>notarial act<\/strong> was to authenticate the marine protest, similar to attesting an affidavit or receiving an acknowledgment.<\/p>\n<p style=\"text-align: justify;\">A <strong>marine protest<\/strong> is a declaration by the captain of the facts regarding a <strong>loss<\/strong> or <strong>damages<\/strong> during a voyage, due to <strong>perils of the sea<\/strong>, storms, bad weather, accidents, collisions, emergencies, and the actions taken by the captain and crew.<!--more--><\/p>\n<p style=\"text-align: justify;\"><strong>Protests<\/strong> might be used as <strong>evidence<\/strong> against the captain or the owners, so they must be made carefully, based on the facts from the captain&#8217;s log-book, and from the memory of the captain or his first mate, or of trustworthy mariners.<\/p>\n<p style=\"text-align: justify;\"><strong>Protests<\/strong> were also made by the captain against the charterers of a ship, or the consignees of goods, for not loading or unloading the ship according to contract or within reasonable delays;<br \/>\nby the merchant against the captain for negligence, misconduct, drunkenness, etc.;<br \/>\nfor not proceeding to sea with due dispatch;<br \/>\nfor not signing bills of lading in the customary form, and for other irregularities.<\/p>\n<p style=\"text-align: justify;\">It was a precaution in cases involving loss or damage to the cargo or the vessel, or to people on board, or any unusual event, which was likely to arouse suspicion or to become the subject of <strong>litigation<\/strong>, <strong>liability<\/strong>, or an insurance claim.\u00a0 Failure of the captain to make a protest immediately upon arrival at a port where he could do so was considered gravely delinquent.<\/p>\n<p style=\"text-align: justify;\">Reference books contained a collection of protests that might be used in almost any serious emergency, such as the destruction of a ship by <strong>fire<\/strong>, damages due to <strong>heavy seas<\/strong> or <strong>capture<\/strong> by the ships of an enemy.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Marine_Protest_in_Aspinwall_Notarial_Records_1648\"><\/span>Marine Protest in Aspinwall Notarial Records, 1648<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Here is a historical example of a <strong>marine protest<\/strong> from the <strong>Aspinwall Notarial Records<\/strong>, from <strong>Boston<\/strong>, in 1648.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><em>Uppon the twentie first day of December 1648 according to the Account of England Before me Wm Aspinwall Notary &amp; Tabellion Public by Authoritie of the Generall Court of Massachusetts admitted &amp; sworne personally appeared Wm Priam Master of the Peter &amp; Paule of <strong>Dover<\/strong> &amp; Thomas Pacie pilot, Henry Wilds mate &amp; Wm Butland quartermaster, who did avouch that in theire late voyag from <strong>Madera<\/strong> they had extreame tempestuous wether, especially about the beginning of this present month whereby twoe pipes (the one of wine the other of strong water) though they were well &amp; sufficiently stowed were through the extremitie of the labouring of the Shipp throwne out of theire places &amp; the pipe of wine staved &amp; all run out &amp; what other damage hath thereby beene done they doe not <\/em><em>knowe, unto which the said persons have also testifyed uppon oath before the Governor. <\/em><\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><em>Wherefore the said master Pylot, mate, &amp; quarter master did in presence of mee the said Notary <strong>protest<\/strong> against all damages which the merchants doe suffer or may pretend to suffer in theire wines by reason of the long &amp; tedious voyage &amp; many stormes they mett with in the\u00a0 said voyage, which being the immediate <strong>hand of God<\/strong> &amp; not by any providence of theirs to be prevented or avoided, neither shipp nor companie are answerable for the same.<\/em><br \/>\n<em>This <strong>protest<\/strong> was reade by the persons aforesaid before me the said Notary ere the bulke of the shipp was broken up.<\/em><\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">Note:\u00a0 <strong>Madeira<\/strong> is a <strong>Portuguese<\/strong> island in the North Atlantic, known for its <strong>wine<\/strong>, and is a popular <strong>port of call<\/strong>. \u00a0 Large 112-gallon casks of wine are known as &#8220;<strong>pipes<\/strong>&#8220;.\u00a0\u00a0 <strong>Strong water<\/strong> is alcohol.\u00a0 <strong>Aspinwall Notarial Records<\/strong> frequently refer to agreements made under the <strong>Rules of Oleron<\/strong>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Maritime_Law\"><\/span>Maritime Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Marine protests<\/strong> are part of <strong>maritime law<\/strong>.\u00a0 The maritime law of <strong>England<\/strong>\u00a0was brought to <strong>New England<\/strong>\u00a0and comes from the <strong>Rules of Oleron<\/strong>, written in 1160.\u00a0 <strong>Oleron<\/strong> is an island off the Atlantic coast of <strong>France<\/strong>.\u00a0 The sea laws were brought to <strong>Oleron<\/strong> on a return trip from the <strong>Second Crusade<\/strong> (1145\u20131149) to the Holy Land.<\/p>\n<p style=\"text-align: justify;\">The laws originated from ancient <strong>maritime laws<\/strong> of the <strong>Mediterranean Sea<\/strong>, used by the Egyptians, Phoenicians, and <strong>Greeks<\/strong>, written in the <strong>Isle of Rhodes<\/strong> (southeast of Greece), also known as <strong>Rhodian Law of the Sea<\/strong>.\u00a0 <strong>Rhode Island<\/strong> is named after the <strong>Isle of Rhodes<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Few states now include taking <strong>marine protests<\/strong> as an authorized power of a <strong>notary<\/strong>.\u00a0 But notaries may take <strong>sworn statements<\/strong> and <strong>affidavits<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Maritime law also applies inland where a navigable body of water crosses state, territorial or international boundaries.\u00a0 See <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/federal-notary-authority\/\" target=\"_blank\" rel=\"noopener noreferrer\">Federal Notary Authority<\/a><\/span><\/strong>.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wagon-trains-contracts-law-1820-1880\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Wagon trains<\/strong><\/a><\/span> during pioneer days followed maritime law, with a wagon master in command.<\/p>\n<p style=\"text-align: justify;\"><strong>Image Credits<\/strong><br \/>\n1.
