\"loose<\/a>Using a Loose Certificate to Notarize a Document<\/h1>\n

A notarial certificate<\/strong><\/a><\/span> must be attached to a notarized document, not an unattached loose certificate.\u00a0 This means that the document must include an acknowledgment<\/strong>, or a jurat<\/strong> (oath<\/strong> or affirmation<\/strong>), or a copy certification<\/strong> before it is notarized.<\/p>\n

The document preparer<\/strong> should include the correct type of notarial certificate, to match the intended purpose<\/strong> of the document.<\/p>\n

Documents that need the permission, approval, agreement or consent of the signer typically have an acknowledgment<\/strong><\/a><\/span> attached.\u00a0 Documents that need the signer to make a sworn<\/strong> statement typically have an oath<\/strong> or affirmation<\/strong><\/a><\/span> attached.\u00a0 A certified copy<\/strong><\/a><\/span> must include a copy certification.<\/p>\n

Security for Loose Certificate<\/h2>\n

For best security<\/strong>, the certificate should be included in the document.\u00a0 If it is missing, the notary can print<\/strong>, type, or stamp<\/strong> the required wording for the certificate, or securely attach a loose certificate<\/strong> to the document by using a staple<\/strong>, not a paper clip, pressed through all pages of the document.<\/p>\n

The certificate should include the state and county (venue<\/strong>), the date<\/strong> and type<\/strong> of notarial act, the name(s)<\/strong> of the signer(s), and the official signature<\/strong>, title, commission expiration date, and stamp<\/strong> of the notary.\u00a0 When a loose certificate<\/strong> is attached, it is a best practice<\/strong> for security to include a description<\/strong> and page count of the attached document, so that the certificate cannot be removed and attached to another document to commit fraud<\/strong>.<\/p>\n

The notary should review the certificate to make sure that it is complete<\/strong> and correct<\/strong>.<\/p>\n

There are several reasons why a loose certificate<\/strong> may be needed.\u00a0 The included certificate on the document may use wording that is not valid, or that is valid in one state but not another state.\u00a0 The notary should make sure the wording complies<\/strong> with state law<\/strong>.<\/p>\n

The notarial certificate may be missing from the document.\u00a0 The most common reason for a missing certificate<\/strong> is because the signer has written the document, such as a letter, rather than an attorney or professional document preparer.<\/p>\n

The document may be in a foreign language<\/strong><\/a><\/span>.\u00a0 The document does not have to be in English.\u00a0 As long as the notary can communicate directly with the signer, in English or another language, the document may be notarized.\u00a0 A loose certificate<\/strong> may be attached.\u00a0 The certificate may be in English or in a foreign language that the notary understands.\u00a0 If the document is going to a foreign country and needs an apostille<\/strong><\/a><\/span> attached by the Colorado Secretary of State, the loose certificate<\/strong> must be in English.<\/p>\n

If a loose certificate<\/strong> is attached, and a notary certificate on the document is not used, the notary should line through or cross out the preprinted certificate and write or type “see attached certificate<\/strong>.”<\/p>\n

A loose certificate<\/strong> may also be used when there is not enough room for a certificate or notary stamp at the end of a document, or when the provided certificate has already been used for one signer, but an additional certificate is needed for another signer.<\/p>\n

Sometimes a document, such as a contract or a lease, is originally signed without being notarized.\u00a0 A loose certificate<\/strong> of acknowledgment may be attached at a later date if the signer meets with a notary.<\/p>\n

A notary should not provide a notarized loose certificate<\/strong> that is not attached to a document or does not include the document description.\u00a0 A notarized loose certificate<\/strong> without a document description included could be attached to another document to commit fraud<\/strong>.<\/p>\n
