The <strong>grantee<\/strong> is the party receiving the interest.<\/p>\n<p style=\"text-align: justify;\">A quitclaim deed, or <strong>non-warranty deed<\/strong>, should be used with caution. It does not include any <strong>warranty<\/strong> of any present ownership or that <strong>clear title<\/strong> is being transferred. The grantor may not be a current owner or the ownership may be clouded or disputed.<\/p>\n<p style=\"text-align: justify;\">It is often used to clear up a technical defect or <strong>cloud<\/strong> in the <strong>chain of title<\/strong> or to release lien claims against the property, such as a deed of correction or a deed of release.<\/p>\n<p><!--more--><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Quitclaim_Deed_versus_Warranty_Deed\"><\/span>Quitclaim Deed versus Warranty Deed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A quitclaim deed is often used in transfers between <strong>family<\/strong> members, to add or remove someone from title, to add or remove property from a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/living-trust-frequent-questions\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>living trust<\/strong><\/a><\/span>, or to change ownership from <strong>joint tenants<\/strong> to <strong>tenants in common<\/strong>, when a warranty deed is not needed.<\/p>\n<p style=\"text-align: justify;\">In Colorado, a <strong>warranty deed<\/strong> that includes the words &#8220;warrant(s) the title&#8221; automatically implies the usual general warranty deed <strong>covenants<\/strong> (CRS 38-30-113). The grantor covenants<br \/>\n(a)\u2002That at the time of the making of such instrument he was lawfully seized of an indefeasible estate in <strong>fee simple<\/strong> in and to the property therein described and has <strong>good right<\/strong> and <strong>full power to convey<\/strong> the same;<br \/>\n(b)\u2002That the same was <strong>free and clear<\/strong> from all encumbrances, except as stated in the instrument; \u2009and<br \/>\n(c)\u2002That he <strong>warrants<\/strong> to the grantee and his heirs and assigns the quiet and peaceable possession of such property and <strong>will defend the title<\/strong> thereto against all persons who may lawfully claim the same.<\/p>\n<p style=\"text-align: justify;\">A <strong>quitclaim<\/strong> deed does not include warranty wording, covenants or title protection.<\/p>\n<p style=\"text-align: justify;\">A longer warranty clause might state free and clear from all former and other grants, bargains, sales, liens, taxes, assessments, encumbrances and restrictions of any kind or nature whatsoever.<\/p>\n<p style=\"text-align: justify;\">A <strong>special warranty deed<\/strong> is used less frequently and only warrants title during the time that the current owner has owned the property, not before then. It is often used when property is acquired by the seller after a <strong>foreclosure<\/strong>.<\/p>\n<p style=\"text-align: justify;\">If buying property with a quitclaim deed or special warranty deed, it is prudent to first do a <strong>title search<\/strong> as due diligence to check for any title problems. Use at your own risk.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Recording_a_Quitclaim_Deed\"><\/span>Recording a Quitclaim Deed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Once the blank spaces in the deed are filled out legibly, all grantors listed must sign the deed in front of a <strong>notary<\/strong>. The grantee(s) does not need to sign the deed. After the deed is notarized, it must be officially <strong>recorded<\/strong> in the county clerk and recorder&#8217;s office for the <strong>county<\/strong> where the property is located.<\/p>\n<p style=\"text-align: justify;\">Be sure to comply with the document recording requirements.\u00a0The mailing address of the grantee must be included. CRS 30-10-406(3)(a) requires that all documents have a top margin of at least one inch and a left, right and bottom margin of at least \u00bd inch.<\/p>\n<p style=\"text-align: justify;\">You must pay a county <strong>recording fee<\/strong> and a state <strong>documentary fee<\/strong>\u00a0of 1 cent per $100 for transactions when the consideration is $500 or more. After the deed is recorded, the county will send it to the party listed at the top of the deed within a few weeks. Make a copy of the notarized deed before giving it to the county.<\/p>\n<p style=\"text-align: justify;\">The current recording fee schedule for El Paso County, Colorado is\u00a0$10.00 for the first page, $5.00 for each additional page.
