A Louisiana notary is a <strong>civil law notary<\/strong>, based on <strong>French law<\/strong> from the code of <strong>Napoleon<\/strong>. French law derives from the <strong>Roman law<\/strong> because France was conquered by the <strong>Roman Empire<\/strong>.<\/p>\n<p style=\"text-align: justify;\">In other states, notary powers are based on <strong>English common law<\/strong>, with less notary training required and fewer notary powers.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"%C2%A72_General_Notary_Powers_Administration_of_Certain_Oaths_in_any_Parish\"><\/span>\u00a72. General Notary Powers; Administration of Certain Oaths in any Parish<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A.(1) Notaries public have power within their several parishes:<br \/>\n(a) To make <strong>inventories<\/strong>, <strong>appraisements<\/strong>, and <strong>partitions<\/strong>;<br \/>\n(b) To receive <strong>wills<\/strong>, make <strong>protests<\/strong>, <strong>matrimonial contracts<\/strong>, <strong>conveyances<\/strong>, and\u00a0generally, all <strong>contracts<\/strong> and <strong>instruments<\/strong> of writing;<br \/>\n(c) To hold <strong>family meetings<\/strong> and <strong>meetings of creditors<\/strong>;<br \/>\n(d) To receive <strong>acknowledgements<\/strong> of instruments under private signature;<br \/>\n(e) To make <strong>affidavits of correction<\/strong>;<br \/>\n(f) To affix the <strong>seals<\/strong> upon the effects of <strong>deceased persons<\/strong>, and to raise the same.<\/p>\n<p style=\"text-align: justify;\">(2) All acts executed by a notary public, in conformity with the provisions of Civil\u00a0Code Art. 1833, shall be <strong>authentic acts<\/strong>.<\/p>\n<p style=\"text-align: justify;\">(3) to exercise all of the\u00a0functions of a notary public and to receive <strong>wills<\/strong> in which he is named as administrator,\u00a0executor, trustee, attorney for the administrator, attorney for the executor, attorney for the\u00a0trustee, attorney for a legatee, attorney for an heir, or attorney for the estate.<\/p>\n<p style=\"text-align: justify;\">B. to administer <strong>oaths<\/strong>\u00a0in any parish of the state, to <strong>swear in<\/strong> persons who appear to give <strong>testimony<\/strong> at a\u00a0<strong>deposition<\/strong> before a general reporter or free-lance reporter and to verify <strong>interrogatories<\/strong> and other pleadings to be used in the\u00a0courts of record of this state.<\/p>\n<p style=\"text-align: justify;\">C. to certify <strong>true copies<\/strong> of any <strong>authentic act<\/strong> or any instrument under private signature passed before him or\u00a0acknowledged before him, and<br \/>\nto make and <strong>certify copies<\/strong>, by any method, of any\u00a0certificate, research, resolution, survey or other document annexed to the original of any\u00a0authentic acts passed before him.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a72.1. Affidavit of corrections<\/strong>&#8211; an act of correction executed before two witnesses and a notary public.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a73. Oaths and acknowledgments<\/strong>&#8211;\u00a0Oaths and acknowledgments, in all cases, may be taken or made by or before any notary\u00a0public.<\/p>\n<h2 style=\"text-align: justify;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Napoleon-painting-1806.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-4207\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Napoleon-painting-1806.jpg\" alt=\"Napoleon painting 1806\" width=\"145\" height=\"200\" \/><\/a>Louisiana Notary Requirements<\/h2>\n<p style=\"text-align: justify;\">The notary must pass an initial <strong>examination<\/strong>, given twice per year in June and December.\u00a0 The official <strong>study guide<\/strong> for the notary exam is \u201c<em>The Fundamentals of Louisiana\u00a0Notarial Law and Practice<\/em>.\u201d\u00a0Applicants are not required by law to take a course or instruction class in order for\u00a0an applicant to take the notary exam. \u00a0The exam is difficult. An exam pre-assessment test is available to show the likelihood of a candidate\u2019s ability pass the notary exam.<\/p>\n<p style=\"text-align: justify;\">An <strong>attorney<\/strong> who is licensed to practice law in Louisiana can apply to obtain a notary\u00a0commission and is exempt from taking the notary exam.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Louisiana_Ex-Officio_Notaries\"><\/span>Louisiana Ex-Officio Notaries<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">In addition to notaries public, Louisiana notary law also authorizes certain <strong>ex-officio notaries public<\/strong>, with limited powers for use in their jobs, in the\u00a0Department of Public Safety and\u00a0Corrections,\u00a0Department of Justice, Department of State, Governor\u2019s Consumer Protection Division,\u00a0Department of Insurance, Louisiana State\u00a0Racing Commission, district attorney offices, police and fire departments, and several other government agencies.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Louisiana_Notary_Laws\"><\/span>Louisiana Notary Laws<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Notarial certificates<\/strong> must begin with a caption specifying the state and place (<strong>parish<\/strong>) where the act is\u00a0completed. Note: Louisiana uses parishes rather than counties.<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1833. Authentic act<\/strong>&#8211;\u00a0A. An <strong>authentic act<\/strong> is a writing executed before a notary public or other officer\u00a0authorized to perform that function, in the presence of <strong>two witnesses<\/strong>, and signed by each\u00a0party who executed it, by each witness, and by each notary public before whom it was\u00a0executed. The typed or hand-printed name of each person shall be placed in a legible\u00a0form immediately beneath the signature of each person signing the act.<\/p>\n<p style=\"text-align: justify;\"><strong>46:XLVI.131. Notary Seal<\/strong>&#8211;\u00a0A. A <strong>notary\u2019s signature<\/strong> is his <strong>seal<\/strong>. If he elects to have a seal to use when notarizing\u00a0documents, he is not required to have a particular style of seal to give authenticity to his\u00a0copies.<br \/>\nB. The <strong>name<\/strong> of the notary and the witnesses must be typed, printed legibly, or stamped.<br \/>\nC. Every document notarized in the state of Louisiana shall have the <strong>notary\u00a0identification number<\/strong> assigned to him\/her by the secretary of state and that number shall\u00a0be typed or printed legibly and placed next to the notary\u2019s name.<\/p>\n<p style=\"text-align: justify;\"><strong>46:XLVI.135. Fees to be Charged by a Notary Public<\/strong>&#8211;\u00a0A.
