contain <strong>confidential<\/strong>, <strong>personal health information<\/strong>.\u00a0 The <strong>Health Insurance Portability and Accountability Act<\/strong> (<strong>HIPAA<\/strong>) <strong>Privacy Rule<\/strong> establishes national standards to protect medical records and other personal health information and applies to health plans, health care clearinghouses, and those health care providers that conduct certain health care transactions electronically.<\/p>\n<p style=\"text-align: justify;\">The <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/CFR-2003-title45-vol1\/xml\/CFR-2003-title45-vol1-chapA.xml#seqnum164.500\" target=\"_blank\" rel=\"noopener noreferrer\">HIPAA Privacy Rule 45 CFR \u00a7 164.510<\/a><\/strong><\/span> requires appropriate <strong>safeguards<\/strong> to protect the <strong>privacy<\/strong> of <strong>personal health information<\/strong> (PHI) and sets limits and conditions on the <strong>uses<\/strong> and <strong>disclosures<\/strong> that may be made of such information with or without <strong>patient authorization<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The Rule also gives <strong>patients rights<\/strong> over their health information, including rights to examine and obtain a copy of their health records and to request corrections.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"HIPAA_Security_Rule\"><\/span>HIPAA Security Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p informed medical decisions on behalf of an <strong>incapacitated principal<\/strong>, the principal must authorize the <strong>agent<\/strong> to inspect or receive copies of the relevant <strong>medical records<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Doctors, hospitals, and other healthcare providers may refuse to provide an agent or other third party with access to private medical records unless a <strong>HIPAA authorization<\/strong> form has been signed by the principal.\u00a0 The medical facility may have an authorization form or contact a health care attorney for a
