financial <strong>power of attorney<\/strong> (<strong>POA<\/strong>).\u00a0 This often occurs when the senior has an illness or disability or is elderly and less able to <a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/02\/ABC_logo_120x80.jpg\"><img decoding=\"async\"  class=\"alignleft wp-image-249 size-full\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/02\/ABC_logo_120x80.jpg\" alt=\"ABC Legal Docs logo\" width=\"120\" height=\"80\" \/><\/a>remember to pay bills on time or to drive to the bank when needed.<\/p>\n<p style=\"text-align: justify;\">The appointed agent has a <strong>duty<\/strong> to act in the <strong>best interest<\/strong> of the <strong>principal<\/strong> who appointed him\/her.\u00a0 Problems may arise when the agent is <strong>dishonest<\/strong> and puts his\/her interest above the best interest of the principal.\u00a0 A <strong>dishonest<\/strong> agent may steal money or property from the principal.<!--more--><\/p>\n<p style=\"text-align: justify;\">Another problem may be that the agent is <strong>trustworthy<\/strong>, but is not <strong>skilled<\/strong> or <strong>competent<\/strong> in <strong>money management<\/strong>, or does not have <strong>enough time<\/strong> to do the job properly.<\/p>\n<p style=\"text-align: justify;\">The <strong>principal<\/strong> should not choose an <strong>agent<\/strong> who has <strong>financial problems<\/strong>, <strong>spending problems<\/strong>,\u00a0 or has issues with <strong>gambling<\/strong> or <strong>substance abuse<\/strong>\u00a0or has previously committed <strong>abuse<\/strong> or <strong>mistreatment<\/strong> of the principal.<\/p>\n<p style=\"text-align: justify;\">Problems may arise when no one is <strong>monitoring<\/strong> the agent to <strong>verify<\/strong> that the agent is performing the required <strong>duties<\/strong> in a timely and proper manner.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Designating_a_Protector\"><\/span>Designating a Protector<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">To add <strong>protection<\/strong> for the <strong>principal<\/strong>, the principal may designate a <strong>protector<\/strong> in the power of attorney to monitor the performance of the agent, or pre-approve checks and spending.\u00a0 The protector should have <strong>money management<\/strong> and <strong>record-keeping<\/strong> skills, such as a <strong>daily money manager<\/strong>, <strong>bookkeeper<\/strong> or <strong>accountant<\/strong>, or another <strong>family member<\/strong> with those skills.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Protector_Powers\"><\/span>Protector Powers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The <strong>protector<\/strong> named in the power of attorney could have the power to <strong>replace<\/strong> the agent if he\/she is not performing the required duties under the terms of the financial <strong>power of attorney<\/strong>.\u00a0 The protector could have the authority to train the agent on proper <strong>record keeping<\/strong> and daily <strong>money management<\/strong>.<\/p>\n<p style=\"text-align: justify;\">A protector would be authorized to <strong>receive copies<\/strong> of all <strong>financial information<\/strong>, including brokerage, bank account, tax and credit card <strong>statements<\/strong>, insurance, benefits, and medical bills, and have the <strong>right to inquire<\/strong> about financial accounts and bills regarding the actions of an agent.\u00a0 The protector would not have the power to appoint themselves as an agent.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Alternate_Agents\"><\/span>Alternate Agents<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The principal can designate a first and second <strong>alternate agent<\/strong>, as a backup, in the event the <strong>primary agent<\/strong> is not willing or able to serve or is <strong>replaced<\/strong> by the protector due to <strong>misfeasance<\/strong> (errors and omissions) or <strong>malfeasance<\/strong> (dishonest acts).\u00a0 The principal could also choose to appoint <strong>co-agents<\/strong>\u00a0so that <strong>two signatures<\/strong> are required for checks and financial transactions.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Trust_with_Protector\"><\/span>Trust with Protector<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Some <strong>trusts<\/strong> are set up to have a <strong>trustee<\/strong> and a <strong>protector<\/strong>.\u00a0 The protector makes sure that the trustee is acting according to the terms of the trust and in the best interest of the <strong>beneficiaries<\/strong>.\u00a0 A <strong>power of attorney<\/strong> can be written to include a protector, in a similar manner to a trust with a protector.<\/p>\n<p style=\"text-align: justify;\">A protector can help to protect a senior citizen and prevent <strong>financial
