This is a rarely used and mostly unknown notarial act. It is not taught in basic notary training, nor described in the notary laws. The process is described under Colorado <strong>real estate<\/strong> law, <strong>CRS\u00a038-30-136, Subsequent Proof of Execution<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The document signer does not appear before the notary. Instead, a <strong>subscribing witness<\/strong> to the document appears before the <strong>notary<\/strong> and\u00a0makes a <strong>sworn statement<\/strong> about the document execution by the signer.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"CRS_38-30-136_Subsequent_Proof_of_Execution\"><\/span><strong>CRS\u00a038-30-136, Subsequent Proof of Execution<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><em>(1) When any <strong>deed<\/strong> or <strong>instrument<\/strong> of writing has been <strong>executed<\/strong> and not <strong>acknowledged<\/strong> according to law at the time of the execution thereof, such deed or instrument of writing may at any subsequent time be <strong>acknowledged<\/strong> by the makers thereof in the manner provided in this article, or <strong>proof<\/strong> may be made of the <strong>execution<\/strong> thereof before any <strong>officer<\/strong>. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>Such officer, when the fact is not within his own knowledge, shall ascertain from the <strong>testimony<\/strong> of at least one <strong>competent<\/strong>, <strong>credible witness<\/strong>, to be <strong>sworn<\/strong> and examined by him, that the person offering to <strong>prove<\/strong> the <strong>execution<\/strong> of such deed or writing is a <strong>subscribing witness<\/strong> thereto. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>Thereupon such officer shall examine such <strong>subscribing witness<\/strong> upon <strong>oath<\/strong> or <strong>affirmation<\/strong>, and shall reduce his <strong>testimony<\/strong> to writing and require the <strong>witness<\/strong> to <strong>subscribe<\/strong> the same, endorsed upon or attached to such <strong>deed<\/strong> or other writing, and shall thereupon grant a <strong>certificate<\/strong> that such witness was <strong>personally known<\/strong> or was <strong>proved to him<\/strong> by the <strong>testimony<\/strong> of at least one <strong>witness<\/strong> (who shall be named in such certificate) to be a <strong>subscribing witness<\/strong> to the <strong>deed<\/strong> or instrument of writing to be proved, that such <strong>subscribing witness<\/strong> was lawfully <strong>sworn<\/strong> and examined by him, and that the <strong>testimony<\/strong> of the said <strong>officer<\/strong> was reduced to writing and by said <strong>subscribing witness<\/strong> subscribed in his presence.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>(2) If by the <strong>testimony<\/strong> it appears that such <strong>witness<\/strong> saw the person, whose name is subscribed to such instrument of writing, <strong>sign<\/strong>, <strong>seal<\/strong>, and <strong>deliver<\/strong> the same or that such person afterwards <strong>acknowledged<\/strong> the same to the said <strong>witness<\/strong> to be his free and <strong>voluntary act<\/strong> or deed and that such witness <strong>subscribed<\/strong> the said deed or instrument of writing in <strong>attestation<\/strong> thereof, in the <strong>presence<\/strong> and with the <strong>consent<\/strong> of the person so executing the same, such <strong>proof<\/strong> if <strong>attested<\/strong> and the authority of the <strong>officer<\/strong> to take the same duly proved in the same manner as required in the case of <strong>acknowledgment<\/strong>, shall have the <strong>same force and effect<\/strong> as an <strong>acknowledgment<\/strong> of said deed or instrument of writing by the person executing the same, and duly certified.<\/em><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Notarial_Certificate_for_Proof_of_Execution\"><\/span>Notarial Certificate for Proof of Execution<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">There is no sample <strong>notarial certificate<\/strong> for a <strong>Proof of Execution<\/strong> shown in Colorado law.
