href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/notary-for-petition-election\/\" target=\"_blank\" rel=\"noopener noreferrer\">election petition<\/a><\/strong><\/span>.\u00a0 The petition may be for a <strong>candidate<\/strong>, to <strong>recall<\/strong> an elected official, or for an <strong>initiative<\/strong> or <strong>referendum<\/strong> on a <strong>ballot issue<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Notaries must be careful when notarizing a petition affidavit because the procedure is defined under Colorado state <strong>election laws<\/strong>, Title 1, or local election laws, not under the notary laws.<\/p>\n<p style=\"text-align: justify;\">It is not the responsibility of the notary to inspect or verify the gathered signatures on the petition.\u00a0 Election officials do that when the notarized petitions are turned in to them.\u00a0 Any signature added to the petition after it has been notarized is procedure for petitions for <strong>candidacy<\/strong> is defined in <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/olls.info\/crs\/crs2025-title-01.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">CRS 1-4-905<\/a><\/strong><\/span>.\u00a0 The petition circulator will gather <strong>qualified signatures<\/strong>, according to the election laws and procedures.\u00a0 When the circulator is done gathering signatures, he\/she needs to sign an <strong>affidavit<\/strong> in the presence of a notary.\u00a0 The circulator statute defines the <strong>specific elements<\/strong> that must be included in the petition affidavit.<\/p>\n<p style=\"text-align: justify;\">The notary takes the affidavit of the circulator by administering an <strong>oath<\/strong> or <strong>affirmation<\/strong> that the statements listed on the petition are true and correct.\u00a0 An <strong>election official<\/strong> may not accept for filing any petition that does not have a notarized affidavit attached.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Petition_Circulator_for_Initiative_or_Referendum\"><\/span>Petition Circulator for Initiative or Referendum<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The affidavit procedure on a circulated petition for an <strong>initiative<\/strong> or <strong>referendum<\/strong> is defined in <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/olls.info\/crs\/crs2025-title-01.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">CRS 1-40-111(2)<\/a><\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">Notaries <strong>beware<\/strong>, the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/notary-certificate\/\" target=\"_blank\" rel=\"noopener noreferrer\">notarial certificate<\/a><\/strong><\/span> for this affidavit requires the notary to <strong>specify the form of identification presented<\/strong> on a blank line in the affidavit form.\u00a0 <em>This is not the normal notary procedure for other types of documents or affidavits.<\/em><\/p>\n<p style=\"text-align: justify;\">To describe the document, the notary may note the last signature line completed on the petition, the petition section number, and the candidate&#8217;s name, referendum or initiative number in the notary journal.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Petition_Circulator_for_Recall\"><\/span>Petition Circulator for Recall<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">For a <strong>recall<\/strong> from office, the petition requirements are defined in CRS 1-12-108.\u00a0 The requirements for the petition affidavit are defined in CRS 1-12-108(6)(b), petition requirements.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Local_Petitions\"><\/span>Local Petitions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Be alert for any additional or different requirements for notarizing a local petition under city, municipal, county or state laws.<\/p>\n<p style=\"text-align: justify;\">In <strong>Colorado Springs<\/strong>, the <strong>City Charter<\/strong>, section 12-30(b), defines the requirements for notarizing an affidavit of a petition circulator.<\/p>\n<p style=\"text-align: justify;\"><em>To each section of a petition, which section may consist of one or more sheets, shall be attached an <strong>affidavit<\/strong> by the Circulator, <\/em><br \/>\n<em>signed under <strong>oath<\/strong> before a Notary Public, <\/em><br \/>\n<em>stating that the Circulator is a <strong>registered elector<\/strong> of the City of Colorado Springs, and <\/em><br \/>\n<em>that the Circulator <strong>personally circulated<\/strong> the paper, <\/em><br \/>\n<em>the <strong>number of signatures<\/strong> thereon, <\/em><br \/>\n<em>that all the signatures were affixed in the <strong>Circulator&#8217;s presence<\/strong>, <\/em><br \/>\n<em>that to the best of the Circulator&#8217;s knowledge each signature appended to the paper is the <strong>genuine signature<\/strong> of the person whose name it purports to be, <\/em><br \/>\n<em>that each signer had an <strong>opportunity<\/strong> before signing to read the <strong>full text<\/strong> of the matter proposed or sought to be reconsidered, and <\/em><br \/>\n<em>that to the best of the Circulator&#8217;s knowledge each signer is an <strong>elector<\/strong> of the City of Colorado Springs.<\/em><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Acceptable_ID_for_Petition_Circulator\"><\/span>Acceptable ID for Petition Circulator<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The types of <strong>acceptable identification<\/strong> for a petition circulator are different from the normal types of identification accepted for other notarized documents. They are listed in <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/olls.info\/crs\/crs2025-title-01.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">CRS 1-1-104 (19.5)(a)<\/a><\/span> acceptable forms of identification for petition circulator<\/strong>. \u00a0If the identification provided has an address, it must be a Colorado address.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"SOS_Training_Guide_for_Petition_Circulators\"><\/span>SOS Training Guide for Petition Circulators<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Secretary of State has an online training guide for petition circulators, including a section on notarizing the petition circulator affidavit.\u00a0 <a href=\"https:\/\/www.coloradosos.gov\/pubs\/elections\/petitionEntities\/training\/contents.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>Colorado Petition Circulator Reference Manual<\/strong><\/span><\/a>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"SOS_Training_Video_Notarization_of_Petition_Affidavits\"><\/span>SOS Training Video, Notarization of Petition Affidavits<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Secretary of State offers a 10-minute notary training video tutorial with a certificate of completion at <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.coloradosos.gov\/pubs\/info_center\/training.html#notary\" target=\"_blank\" rel=\"noopener noreferrer\">Notarization of Petition Affidavits video<\/a><\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">We have created a transcript of the tutorial as a notary learning aid at <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Notarization-of-Petition-Affidavits-Tutorial.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Notarization of Petition Affidavits course transcript<\/a><\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">Notaries, please note that <strong>blank spaces<\/strong> are not normally allowed in notarized documents. But for petitions, blank spaces on unused petition signature lines are allowed. (See training tutorial.) Blank lines (blocks of information for a petition signer) will not be counted by election officials when tallying signatures.<\/p>\n<p style=\"text-align: justify;\">Colorado SOS election rule 15.4.6, on statewide initiative petitions, states: Election staff will count each line with writing on each petition section.\u00a0 Staff will not count blank or completely crossed-out lines.
