class=\"alignleft size-full wp-image-204\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\" alt=\"Colorado Notary Law\" width=\"120\" height=\"80\" \/><\/a>er&#8217;s <strong>awareness<\/strong> and <strong>willingness<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Awareness\"><\/span>Awareness<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">As a <strong>layperson<\/strong>, a notary does not make a <strong>medical diagnosis<\/strong> or <strong>legal opinion<\/strong> of <strong>mental incompetence<\/strong>.\u00a0 The legal procedure for declaring a person mentally incompetent requires a mental competency <strong>hearing<\/strong> by a court and a <strong>psychiatric<\/strong> or <strong>psychological<\/strong> <strong>evaluation<\/strong>.\u00a0 The alleged incompetent person has the right to <strong>due process<\/strong> of law.\u00a0 We are presumed to be mentally competent unless proven otherwise.<\/p>\n<p style=\"text-align: justify;\">Even medical professionals and attorneys may <strong>disagree<\/strong> on whether a person can understand the <strong>purpose<\/strong> and <strong>consequences<\/strong> of signing a document.\u00a0 Many legal documents are complicated and filled with legal terms the average person may not understand without legal training.\u00a0 <strong>Lawyers<\/strong> and <strong>judges<\/strong> often disagree and may have different <strong>legal opinions<\/strong>.<\/p>\n<p style=\"text-align: justify;\">To make matters worse, some types of <strong>mental impairment<\/strong> are <strong>transient<\/strong>.\u00a0 The person&#8217;s level of <strong>awareness<\/strong> may vary from time to time.\u00a0 Temporary impairment may be due to the nature of the <strong>illness<\/strong> or <strong>injury<\/strong>, use of <strong>drugs<\/strong>, <strong>alcohol<\/strong> or <strong>prescription<\/strong> <strong>medication<\/strong>, or due to emotional <strong>stress<\/strong> or <strong>trauma<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The notary should use <strong>reasonable care<\/strong> as a layperson to decide if the signer appears to be <strong>aware<\/strong> of the <strong>purpose<\/strong> and <strong>consequences<\/strong> of the document.\u00a0 If the signer can <strong>respond<\/strong> coherently to <strong>basic questions<\/strong> from the notary about the notarial act, then the notary may consider the signer to be <strong>aware<\/strong>.<\/p>\n<p style=\"text-align: justify;\">If the notary knows of any <strong>expert opinion<\/strong> of the person&#8217;s <strong>physician<\/strong> or <strong>attorney<\/strong>, the expert&#8217;s remarks about awareness should be noted in the <strong>journal<\/strong>.\u00a0 If a <strong>witness<\/strong> is also present during the signing, the witness information should be noted in the journal.<\/p>\n<p style=\"text-align: justify;\">Over time, a notary may meet a person who does not seem to be aware.\u00a0 The notary should <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/declining-refusing-notary-service\/\" target=\"_blank\" rel=\"noopener noreferrer\">refuse to notarize<\/a><\/strong><\/span> the document and should make a note in the <strong>notary journal<\/strong> of the reason.\u00a0 An occasional journal entry of refusing to notarize due to lack of <strong>awareness<\/strong> is evidence that the notary is checking for awareness of signers and not ignoring it.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Willingness\"><\/span>Willingness<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The notary should also check for <strong>willingness<\/strong>.\u00a0 The person must sign a document <strong>voluntarily<\/strong>, not under a <strong>threat<\/strong>, <strong>deception<\/strong> or <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/coercion-duress-undue-influence-notarizing\/\" target=\"_blank\" rel=\"noopener noreferrer\">duress<\/a><\/strong><\/span>.\u00a0 The notary may ask if the signer is signing willingly.\u00a0 If the notary has reason to believe the signer is not signing willingly, the notary should <strong>refuse<\/strong> to notarize the document.<\/p>\n<p style=\"text-align: justify;\">If another person is present that appears to be causing <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/coercion-duress-undue-influence-notarizing\/\" target=\"_blank\" rel=\"noopener noreferrer\">undue influence<\/a><\/strong><\/span> on the signer, the notary may ask that person to leave so the notary may speak to the signer <strong>privately<\/strong> to determine willingness.<\/p>\n<p style=\"text-align: justify;\">Most notary signings are routine and there is no reason to suspect problems of <strong>awareness<\/strong> or<strong> willingness<\/strong>.\u00a0 If the signer has approached the notary to request a notarization and is able to answer questions, there is little doubt about awareness.\u00a0 The notary should use <strong>reasonable care<\/strong> to observe and check for awareness and willingness and <strong>refuse<\/strong> to notarize when appropriate, noting the reason in the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/notary-journal-notes\/\" target=\"_blank\" rel=\"noopener noreferrer\">notary journal<\/a><\/strong><\/span>.<\/p>\n<p style=\"text-align:
