The principal retains power.<\/p>\n<p style=\"text-align: justify;\">Hot powers should be used with caution, because they grant\u00a0more <strong>authority<\/strong> to the <strong>agent<\/strong>, and\u00a0have more potential for problems\u00a0by an abusive, dishonest, negligent or incompetent agent. They can significantly reduce\u00a0the principal\u2019s property or change\u00a0the principal\u2019s <strong>estate plan<\/strong>.<\/p>\n<p style=\"text-align: justify;\">On\u00a0January 1, 2010, the <strong>Uniform Power of Attorney Act<\/strong> (<strong>UPOAA<\/strong>) became effective law in <strong>Colorado<\/strong>. The act defines procedures for creating and using a power of attorney in Colorado. About half of the\u00a0states have implemented UPOAA.<\/p>\n<p style=\"text-align: justify;\">As a result of the new law, Colorado no longer allows for assignments of certain hot powers with broad and general language, such as \u201cauthority over all my personal finances.\u201d\u00a0They\u00a0must be granted with <strong>express language<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Cautionary_Warning_for_Hot_Powers\"><\/span><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/caution-sign.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-3200\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/caution-sign.jpg\" alt=\"caution sign\" width=\"200\" height=\"143\" \/><\/a>Cautionary Warning for Hot Powers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The sample POA form included in the Colorado \u00a0statutes includes the following warning:<\/p>\n<p style=\"text-align: justify;\"><em><strong>CAUTION<\/strong>: Granting any of the following will give your agent the authority to take\u00a0actions that could significantly reduce your property or change how your property is\u00a0<\/em><em>distributed at your death. INITIAL ONLY the specific authority you WANT to give your agent.<\/em><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"CRS_15-14-724_Authority_that_Requires_Specific_Grant\"><\/span>CRS 15-14-724\u00a0Authority that Requires Specific Grant<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Colorado statute 15-14-724 lists the hot powers that require specific authority in a power of attorney.<\/p>\n<p style=\"text-align: justify;\">An agent under a power of attorney may do the following on behalf of the principal, or with the principal&#8217;s property, only if the power of attorney expressly grants the agent the authority, and exercise of the authority is not otherwise prohibited by another agreement or instrument to which the authority or property is subject:<\/p>\n<p style=\"text-align: justify;\"><strong>Trusts<\/strong>: Create, amend, revoke, or terminate an intervivos trust (living trust);<br \/>\n<strong>Gifts<\/strong>: Make a gift;<br \/>\n<strong>Survivorship<\/strong>: Create or change rights of survivorship;<br \/>\n<strong>Beneficiaries<\/strong>: Create or change a beneficiary designation;<br \/>\n<strong>Delegating<\/strong>: Delegate authority granted under the power of attorney;<br \/>\n<strong>Annuities<\/strong>: Waive the principal&#8217;s right to be a beneficiary of a joint and survivor annuity, including a survivor benefit under a retirement plan;<\/p>\n<p style=\"text-align: justify;\"><strong>Fiduciary power<\/strong>: Exercise a\u00a0power held by the principal in a fiduciary capacity that the principal has the authority to delegate;<\/p>\n<p style=\"text-align: justify;\">Exercise a power to nominate, appoint, or remove a fiduciary or to consent, veto, or otherwise participate in the designation or changing of a fiduciary; or<\/p>\n<p style=\"text-align: justify;\">Exercise a power to direct a fiduciary in the exercise of a power of the fiduciary with respect to property subject to the fiduciary relationship, including, but not limited to, a power to\u00a0direct investments, or to consent, veto, or otherwise participate in controlling the exercise of such a power.<\/p>\n<p style=\"text-align: justify;\"><strong>Disclaim property or appointment<\/strong>:\u00a0Disclaim or release property or a power of appointment;<\/p>\n<p style=\"text-align: justify;\">Except for the exercise of a general power of appointment for the benefit of the principal, to the extent that the agent is authorized as provided in section 15-14-734, or<\/p>\n<p style=\"text-align: justify;\">for the benefit of persons other than the principal, to the extent that the agent is authorized to make gifts as provided in section 15-14-740, exercise a power of appointment; or<\/p>\n<p style=\"text-align: justify;\">Except with respect to an entity owned solely by the principal, exercise powers, rights, or authority as a partner, member, or manager of a partnership, limited liability\u00a0company, or other entity that the principal may exercise on behalf of the entity and has authority to delegate.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Protective_Measures_When_Authorizing_Hot_Powers\"><\/span>Protective Measures When Authorizing Hot Powers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Trust, but verify. For the <strong>protection<\/strong> of the principal, it is good practice to include some type of <strong>monitoring<\/strong> of the agent&#8217;s actions. This might include ongoing\u00a0reviews by a third party of <strong>financial statements<\/strong> for bank accounts, investment accounts, credit card accounts, tax returns, will and trust documents, real estate documents, motor vehicle titles, insurance policies, annuity policies, contracts, gifts, household inventories, and business financial records, if applicable.<\/p>\n<p style=\"text-align: justify;\">The agent is required to keep a <strong>record of all receipts, disbursements, and transactions<\/strong> made on behalf of the principal, but, a dishonest agent might keep false or incomplete records. So, it would be better to view records directly from the source, such as bank, credit card and investment statements.<\/p>\n<p style=\"text-align: justify;\">A trusted family member might serve as a <strong>monitor<\/strong> or<strong> protector<\/strong>, or an independent professional might be hired, such as an <strong>accountant<\/strong>, <strong>bookkeeper<\/strong>, secretary, virtual assistant or <strong>daily money manager<\/strong>. The monitor\u00a0could be authorized to report abnormal or <strong>suspicious activity<\/strong> to\u00a0the principal, social services, a\u00a0government agency, an\u00a0attorney, or another party or adviser.<\/p>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/gavel-200x200.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-2447\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/gavel-200x200.jpg\" alt=\"gavel\" width=\"200\" height=\"200\" \/><\/a>CRS 15-14-714, Agent&#8217;s duties<\/strong>, requires the agent to <strong>disclose records<\/strong> when ordered by a <strong>court<\/strong> or requested by the principal, a <strong>guardian<\/strong>, a <strong>conservator<\/strong>,\u00a0another <strong>fiduciary<\/strong> acting for the principal, a governmental agency having authority to <strong>protect the welfare<\/strong> of the principal, or, upon the death of the principal, by the <strong>personal\u00a0representative<\/strong> or successor in interest of the principal&#8217;s estate.<\/p>\n<p style=\"text-align: justify;\"><strong>Health care providers<\/strong> taking care of the principal may be required to report suspicion or evidence of <strong>abuse<\/strong> or <strong>exploitation<\/strong> to <strong>Adult Protective Services<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Another method of adding protection is to use <strong>co-agents<\/strong>, and require the approval\u00a0of both co-agents to exercise any hot powers, or for transactions over a stated\u00a0dollar amount. In case co-agents cannot agree, a <strong>tie-breaking procedure<\/strong> is needed, such as\u00a0a <strong>vote<\/strong> from an attorney, accountant, tax adviser or financial adviser.<\/p>\n<p style=\"text-align: justify;\"><strong>CRS 15-14-717, Agent&#8217;s liability.<\/strong> If an agent is found to have violated his duties, he must restore the principal\u2019s property and reimburse for attorney fees and costs.
