Disaster Emergency Act<\/strong>, CRS 24-33.5-701, describes emergency conditions, government authority, and procedures for managing local and state disasters and emergencies.<\/p>\n<p style=\"text-align: justify;\">The purpose is <strong>public safety<\/strong>, to plan, prepare, prevent and cooperate to protect people and communities from damage, injury and loss of life and property, and to respond, restore and recover from disasters.<\/p>\n<p style=\"text-align: justify;\">It also provides for an <strong>emergency management<\/strong> system. It does not limit the authority of the <strong>governor<\/strong> to declare <span style=\"text-decoration: underline;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/martial-law-colorado\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>martial law<\/strong><\/a><\/span> or to exercise other powers under the <strong>constitution<\/strong>, statutes or common law.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Definition_of_Disaster\"><\/span>Definition of Disaster<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">CRS 24-33.5-703 defines a disaster as <em>the occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from any natural cause or cause of human origin, including but not limited to fire, flood, earthquake, wind, storm, wave action, hazardous substance incident, oil spill or other water contamination requiring emergency action to avert danger or damage, volcanic activity, epidemic, air pollution, blight, drought, infestation, explosion, civil disturbance, hostile military or paramilitary action, or a condition <\/em><em>of riot, insurrection, or invasion existing in the state or in any county, city, town, or district in the state.<\/em><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Executive_Orders\"><\/span>Executive Orders<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The governor may issue <strong>executive orders<\/strong>, <strong>proclamations<\/strong>, and regulations and amend or rescind them. Executive orders, proclamations, and regulations have the force and effect of law.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Declaration_of_Disaster\"><\/span>Declaration of Disaster<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/flood-disaster-family.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-3055\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/flood-disaster-family.jpg\" alt=\"flood disaster family\" width=\"220\" height=\"168\" \/><\/a>A disaster emergency shall be declared by executive order or proclamation of the governor if the governor finds a disaster has\u00a0occurred or that this occurrence or the threat thereof is imminent.<\/p>\n<p style=\"text-align: justify;\">The <strong>state of disaster emergency<\/strong> shall continue until the governor finds that the threat of danger has passed or that the disaster has been dealt with to the extent that emergency conditions no longer exist.<\/p>\n<p style=\"text-align: justify;\">The governor terminates the state of disaster emergency by executive order or proclamation, but no state of disaster emergency may continue for longer than <strong>thirty days<\/strong> unless renewed by the governor.\u00a0The general assembly, by joint resolution, may terminate a state of disaster emergency at any time.<\/p>\n<p style=\"text-align: justify;\">A state of disaster emergency shall activate the disaster <strong>response<\/strong> and <strong>recovery<\/strong> aspects of the state, local, and interjurisdictional disaster emergency plans, and authorize the deployment and use of any forces to which the plans apply.\u00a0\u00a0The governor is the\u00a0<strong>commander-in-chief<\/strong> of the organized and unorganized militia and of all other forces available for emergency duty.<\/p>\n<p style=\"text-align: justify;\">The governor may <strong>suspend<\/strong> the provisions of any regulatory <strong>statute<\/strong> for the conduct of state business or the <strong>orders<\/strong>, <strong>rules<\/strong>, or <strong>regulations<\/strong> of any <strong>state agency<\/strong>\u00a0if strict compliance would prevent, hinder, or delay necessary action in coping with the emergency.<\/p>\n<p style=\"text-align: justify;\">The governor may commandeer or utilize any <strong>private property<\/strong> if the governor finds this necessary to cope with the disaster emergency. Compensation for use or destruction shall be calculated in the same manner as compensation due for the taking of property pursuant to <strong>eminent domain<\/strong> procedures.<\/p>\n<p style=\"text-align: justify;\">The governor may direct and compel the <strong>evacuation<\/strong> of all or part of the population from any stricken or threatened area within the state if the governor deems this action necessary for the <strong>preservation of life<\/strong> or other <strong>disaster mitigation<\/strong>, response, or recovery.<\/p>\n<p style=\"text-align: justify;\">The governor may\u00a0suspend or limit the sale, dispensing, or transportation of <strong>alcoholic beverages<\/strong>, <strong>firearms<\/strong>, explosives, or combustibles.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Emergency_Epidemic\"><\/span>Emergency Epidemic<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">During an <strong>emergency epidemic<\/strong>, the governor shall be advised by an expert emergency epidemic response committee and shall act regarding reasonable and appropriate measures to reduce or prevent the spread of the disease, agent, or toxin and to protect the public health.<\/p>\n<p style=\"text-align: justify;\">This includes issuing orders to <strong>physicians<\/strong> and <strong>hospitals<\/strong>, taking supplies of medicines and vaccines, placing persons or property in <strong>quarantine<\/strong>, seizing and destroying contaminated property, and safely disposing of corpses and infectious waste.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Office_of_Emergency_Management\"><\/span>Colorado Office of Emergency Management<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Colorado\u00a0<strong>Office of Emergency Management<\/strong> is part of the\u00a0Colorado\u00a0<strong>Division of Homeland Security<\/strong>\u00a0and <strong>Emergency Management<\/strong> (<strong>DHSEM<\/strong>) in the\u00a0<strong>Department of Public Safety<\/strong>\u00a0(<strong>DPS<\/strong>).\u00a0The office of emergency management shall prepare, maintain, and keep current a <strong>state disaster plan<\/strong> that complies with all applicable federal and state regulations.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Disaster_Emergency_Fund\"><\/span>Disaster Emergency Fund<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The act establishes a disaster emergency fund, but the first recourse is to use funds regularly appropriated to state and local agencies. If the money available in the fund is insufficient, the governor may transfer and expend money appropriated for other purposes.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Local_Disaster_Agencies\"><\/span>Local Disaster Agencies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Each political subdivision is within the <strong>jurisdiction<\/strong> of and served by the office of emergency management and by a local or interjurisdictional agency responsible for disaster preparedness and coordination of the response.<\/p>\n<p style=\"text-align: justify;\">Each local and interjurisdictional <strong>disaster agency<\/strong> shall prepare and keep current a local or interjurisdictional <strong>disaster emergency plan<\/strong> for its area.\u00a0The <strong>sheriff<\/strong> of each county shall be the official responsible for the coordination of all <strong>search and rescue<\/strong> operations within the sheriff&#8217;s jurisdiction.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Local_Disaster_Emergencies\"><\/span>Local Disaster Emergencies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A <strong>local disaster<\/strong> may be declared only by the <strong>principal executive officer<\/strong> of a political subdivision. It shall not be continued or renewed for a period in excess of <strong>seven days<\/strong> except by or with the consent of the governing board of the political subdivision. A\u00a0declaration of a local disaster emergency activates the local and interjurisdictional disaster emergency plans and authorizes the furnishing of aid and assistance under such plans.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Interoperable_Public_Safety_Radio_Systems\"><\/span>Interoperable Public Safety Radio Systems<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Public safety agencies, including law enforcement, fire protection, emergency medical, or emergency response services, shall use interoperable communications, able to communicate on-demand and in real-time by <strong>voice<\/strong> or <strong>data<\/strong> using compatible <strong>radio\u00a0communication systems<\/strong> or other technology.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Governor_Commander-in-Chief_of_Militia\"><\/span>Governor Commander-in-Chief of Militia<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Article IV, Section 5 of the <strong>Colorado Constitution<\/strong> states: The governor shall be <strong>commander-in-chief<\/strong> of the <strong>military forces<\/strong> of the state, except when they shall be called into actual service of the United States.
