Executed on (date).<\/em>&#8220;<\/p>\n<p style=\"text-align: justify;\">A Federal notary, state notary, or notary stamp is not required. The unsworn declaration may be made inside or outside of the United States, with different wording used for each case. This simplifies the paperwork process for submitting many forms to a Federal agency, by eliminating the need to use a notary. \u00a0However, some forms, a <strong>deposition<\/strong>, an <strong>oath of office<\/strong>, or an oath before a specified official still need a notary.<\/p>\n<p style=\"text-align: justify;\">According to the House Report, the primary goal of the legislation was to eliminate the inconvenience of finding a notary every time an affidavit needed to be signed, by permitting the use of unsworn declarations under penalty of perjury, in lieu of affidavits.<!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Federal_Law_Unsworn_Declaration_28_USC_1746\"><\/span>Federal Law, Unsworn Declaration, 28 USC 1746<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Federal law passed in 1976, to permit the use of unsworn declarations under penalty of perjury as evidence in Federal proceedings. It is under\u00a0Title 28 &#8211; Judiciary and Judicial Procedure,\u00a0Part V &#8211; Procedure,\u00a0Chapter 115 &#8211; <strong>Evidence; Documentary<\/strong>. It states:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><em>Wherever, under any law of the United States or under any rule, regulation, order, or requirement made pursuant to law, any matter is required or permitted to be supported, evidenced, established, or proved by the sworn declaration, verification, certificate, statement, oath, or affidavit, in writing of the person making the same (other than a deposition, or an oath of office, or an oath required to be taken before a specified official other than a notary public), such matter may, with like force and effect, be supported, evidenced, established, or proved by the <strong>unsworn declaration<\/strong>, certificate, verification, or statement, in writing of such person which is subscribed by him, as true under penalty of perjury, and dated, in substantially the following form:<\/em><\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><em>(1) If executed <strong>without the United States<\/strong>: \u201cI declare (or certify, verify, or state) under penalty of perjury under the laws of the United States of America that the foregoing is true and correct. Executed on (date).<\/em><br \/>\n<em>(Signature)\u201d.<\/em><\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><em>(2) If executed <strong>within the United States<\/strong>, its territories, possessions, or commonwealths: \u201cI declare (or certify, verify, or state) under penalty of perjury that the foregoing is true and correct. Executed on (date).<\/em><br \/>\n<em>(Signature)\u201d.<\/em><\/p>\n<p style=\"text-align: justify;\">An unsworn declaration may\u00a0also be referred to as a <strong>certificate<\/strong>, <strong>certification<\/strong>,\u00a0<strong>verification,<\/strong> or <strong>statement<\/strong>, depending on the wording used. Some forms use the word attest, attested, or <strong>attestation<\/strong>. But, if the document body says <strong>affidavit<\/strong>, affiant, oath, sworn to, deposed, or affirmed, or a <strong>jurat<\/strong> notarial certificate is included, that indicates an authorized notarial officer must administer an oath or affirmation.<\/p>\n<p style=\"text-align: justify;\">Some documents may have an incorrect or misleading title, but the laws for an unsworn declaration do not specify a requirement for the document title, only for the wording of the declaration.<\/p>\n<p>\u201cUnsworn declaration\u201d means a declaration in a signed record that is not given under oath, but is given under penalty of perjury.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"State_Laws_Authorizing_Unsworn_Declaration\"><\/span>State Laws Authorizing Unsworn Declaration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">About 30 states have passed laws authorizing some form of unsworn declaration including:<br \/>\nAlaska, Arizona, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=CCP&amp;sectionNum=2015.5.\" target=\"_blank\" rel=\"noopener\">California<\/a><\/span>, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/codes.findlaw.com\/co\/title-13-courts-and-court-procedure\/co-rev-st-sect-13-27-106.html\" target=\"_blank\" rel=\"noopener\">Colorado<\/a><\/span>, D.C., <span style=\"text-decoration: underline;\"><br \/>\n<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0092\/Sections\/0092.525.html\" target=\"_blank\" rel=\"noopener\">Florida<\/a><\/span>, Guam, Hawaii, Illinois, Indiana,<br \/>\nIowa, Kansas, Maryland, Massachusetts, Michigan,<br \/>\nMinnesota, Missouri, Montana, Oklahoma, Nevada,<br \/>\nNew Jersey, New York, Oklahoma, Oregon, Pennsylvania, Rhode Island (pending),<span style=\"text-decoration: underline;\"><br \/>\n<a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/CP\/htm\/CP.132.htm\" target=\"_blank\" rel=\"noopener\">Texas<\/a><\/span>, Utah, Virginia, Washington, West Virginia, and Wyoming.<br \/>\n(Note: see individual state laws for details, there may be more states that have introduced or passed new laws.)<\/p>\n<p style=\"text-align: justify;\">There may be <strong>restrictions<\/strong> limiting an unsworn declaration to certain situations, cases, or locations inside or outside the state. Some of the state statutes are not as broad as the Federal law in allowing the use of an unsworn declaration in lieu of an affidavit. The Federal law does not authorize the use of unsworn declarations in state courts or agencies. Without a state law allowing an unsworn declaration, it is <strong>hearsay<\/strong> evidence in state court.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Uniform_Unsworn_Foreign_Declarations_Act_UUFDA\"><\/span>Uniform Unsworn Foreign Declarations Act (UUFDA)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Uniform Unsworn Foreign Declarations Act (<strong>UUFDA<\/strong>) was promulgated in 2008 and\u00a0has since been enacted in 20 states, including <strong>Colorado<\/strong>. The Act authorizes the use in litigation and certain agency\u00a0filings of unsworn declarations made in a <strong>foreign country<\/strong>, outside the United States, under penalty of perjury.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Uniform_Unsworn_Declarations_Act_UUDA\"><\/span>Uniform Unsworn Declarations Act (UUDA)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">In 2018, Colorado passed the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.uniformlaws.org\/committees\/community-home?communitykey=2453b1ec-4689-47db-bd74-0bdcfa514d4e\" target=\"_blank\" rel=\"noopener\">Uniform Unsworn Declarations Act<\/a><\/span>, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/codes.findlaw.com\/co\/title-13-courts-and-court-procedure\/co-rev-st-sect-13-27-101.html\" target=\"_blank\" rel=\"noopener\">CRS 13-27-101<\/a><\/span>, to extend the use of an unsworn declaration made either inside or outside the United States.
