\/><\/a>Electronic Notary, E-Notary Colorado<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p style=\"text-align: justify;\"><strong>Colorado notary law<\/strong> allows a Colorado notary to apply to become an <strong>electronic notary<\/strong> or <strong>e-notary<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The notary must be currently in good standing, must study the Colorado laws for <strong>electronic notarization<\/strong>, and submit an <strong>online application<\/strong> to the Colorado <strong>Secretary of State<\/strong> (<strong>SOS<\/strong>).\u00a0 There is no training or exam required, and there is no application fee.<\/p>\n<p style=\"text-align: justify;\">Electronic notarization is used on <strong>electronic documents<\/strong> that are signed by the customer with an <strong>electronic signature<\/strong> and then <strong>notarized electronically<\/strong>.\u00a0 <strong>Paper documents<\/strong> are not used.<\/p>\n<p style=\"text-align: justify;\">E-notarization does not mean <strong>remote notarization<\/strong>\u00a0with a <strong>remote notary<\/strong> by audio\/video communication.\u00a0 All requirements of a &#8220;<strong>wet ink<\/strong>&#8221; paper notarization must be met.<!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Physical_Presence\"><\/span>Physical Presence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The customer must meet in person (<strong>physical presence<\/strong>) with the e-notary and provide <strong>satisfactory identification<\/strong>.\u00a0 There must be a <strong>notary certificate<\/strong> on the document.\u00a0 There must be no <strong>blank spaces<\/strong> in the document.\u00a0 The e-notary follows the normal procedure for an <strong>acknowledgment<\/strong>, <strong>oath<\/strong> or <strong>affirmation<\/strong> with the customer.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Electronic_Signature\"><\/span>Electronic Signature<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">In Colorado, the definition and requirements for an electronic signature and electronic records are found in the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Uniform-Electronic-Transactions-Act-UETA-Colorado.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Uniform Electronic Transactions Act<\/a><\/strong><\/span>\u00a0(<strong>UETA<\/strong>) at CRS 24-71.3-101.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Tamper-Evident_Technology\"><\/span>Tamper-Evident Technology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">CRS 24-21-520 requires the notary to select one or more <span style=\"background-color: #ffff00;\"><strong>tamper-evident<\/strong><\/span> technologies to use when performing notarial acts on electronic records. The notary is not required to support all technologies requested by customers.<\/p>\n<p style=\"text-align: justify;\">Under RULONA Section 20(a), tamper-evident technology is &#8220;one that is designed to allow a person inspecting an electronic record to determine whether there has been any tampering with the integrity of a certificate of notarial act logically associated with a record or with the attachment or association of the notarial act with that electronic record.&#8221;<\/p>\n<p style=\"text-align: justify;\">The notary must notify the SOS before performing electronic notarization and must identify the technology to be used. The technology selected must comply with any rules or standards for approval of technology established by the SOS per CRS 24-21-527.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Document_Authentication_Number_DAN\"><\/span>Document Authentication Number (DAN)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The e-notary attaches an <strong>electronic notary signature<\/strong> and a unique <strong>Document Authentication Number<\/strong> (<strong>DAN<\/strong>), issued to that notary by the SOS.\u00a0 Fifty DANs are issued at a time.<\/p>\n<p style=\"text-align: justify;\">The DAN consists of two parts: the notary&#8217;s\u00a0<strong>ID number<\/strong>, followed by a <strong>random number<\/strong>, generated by the SOS computer.\u00a0 The DAN is the <strong>legal equivalent<\/strong> of using a <strong>notary seal<\/strong> or <strong>embosser<\/strong> on a paper document.<\/p>\n<p style=\"text-align: justify;\">The notary records the transaction in the <strong>notary journal<\/strong>, including the Document Authentication Number.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Electronic_Notary_Fee\"><\/span>Electronic Notary Fee<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The maximum notary fee allowed for notarizing a <strong>paper document<\/strong> is <strong>$5<\/strong>.<br \/>\nThe maximum notary fee allowed for notarizing an <strong>electronic document<\/strong> is <strong>$10<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Currently, there is limited use of electronic notarization, but it is expected to increase over time. It can speed up document delivery by sending the document immediately by email or uploading to the destination, without using paper documents, express shipping or U.S. Postal Service mail delivery.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Electronic_Notary_Tutorial\"><\/span>Electronic Notary Tutorial<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The Colorado SOS has created an <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Colorado-SOS-eNotary-Tutorial-Slides.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">electronic notary tutorial<\/a><\/strong><\/span>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Remote_Online_Notarization_RON_Update\"><\/span>Colorado Remote Online Notarization (RON) Update<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Note: Over 20 states, including Virginia, have approved the use of <strong>remote online notarization<\/strong> (RON) by two-way audio\/video communication with a remote notary.<\/p>\n<p style=\"text-align: justify;\">Colorado lawmakers proposed the use of remote online notarization, in 2018 and 2019, but the bills did not pass the state legislature. The proposed maximum fee for remote notarization was $25.\u00a0 Another RON bill was submitted in January 2020 and is pending review and approval, but the legislature took an emergency recess. The SOS would develop notary rules for implementing remote online notarization.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Colorado_Remote_Notarization_Rule_5_and_New_Law_Approved\"><\/span><span style=\"background-color: #00ff00;\"><strong>Colorado Remote Notarization Rule 5 and New Law Approved<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">On March 28, 2020, due to the <strong><span style=\"background-color: #ffff00;\">coronavirus<\/span> <\/strong>disease 2019 (<strong><span style=\"background-color: #ffff00;\">COVID-19<\/span><\/strong>) <strong>pandemic<\/strong> public health emergency, Governor Jared Polis signed an emergency order to temporarily suspend the requirement for a personal appearance before a notary and to allow remote notarization in Colorado using two-way audio\/video communication. On March 30th, the Secretary of State released Colorado SOS Notary Rule 5 for Remote Notarization. This was a temporary emergency rule, not a statute passed by legislation.<\/p>\n<p style=\"text-align: justify;\">Authorization to perform remote notarizations under a new RON law was passed in June 2020, and became effective on <strong><span style=\"background-color: #ffff00;\">January 1, 2021<\/span><\/strong>.<\/p>\n<p style=\"text-align: justify;\">Notaries are not required to offer remote notarization and may choose an acceptable audio\/video platform. Notaries need to learn and understand the new law, set up an account with an approved audio\/video RON platform vendor, and gain experience with the new procedure.
