Douthit, of <strong>Las Animas County<\/strong>, took the <strong>sworn statement<\/strong> (<strong>affidavit of depredation<\/strong>) of a livestock dealer from <strong>Trinidad<\/strong>, Colorado, that <strong>Arapahoe Indians<\/strong> had stolen a <strong>horse<\/strong> valued at $250, sixteen years earlier in 1872.<\/p>\n<p style=\"text-align: justify;\">The statement was one of several affidavits sent as evidence for a <strong>depredation claim<\/strong> filed with the <strong>Office of Indian Affairs<\/strong>, under the <strong>Department of the Interior<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>Colorado Territory<\/strong> existed from 1861 until statehood in 1876.\u00a0 So, although Douthit was a notary for the State of Colorado in 1888, the horse was stolen in 1872, in former Colorado Territory.<\/p>\n<h2 style=\"text-align: justify;\"><!--more--><img decoding=\"async\"  class=\"alignleft size-full wp-image-2327\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Silenced-War-Whoop-250x180.jpg\" alt=\"Silenced War Whoop\" width=\"250\" height=\"180\" \/>Colorado Affidavit of Depredation, 1888<\/h2>\n<p style=\"text-align: justify;\">The horse theft occurred after the <strong>Sand Creek Massacre<\/strong> of 1864, where <strong>Cheyenne<\/strong> and <strong>Arapahoe Indians<\/strong> were killed by soldiers from <strong>Denver<\/strong>, led by Colonel John <strong>Chivington<\/strong>, in their village on Sand Creek, in eastern Colorado Territory.<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"State_of_Colorado_County_of_Las_Animas\"><\/span><em><strong>State of Colorado, County of Las Animas<\/strong><\/em><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><em>In the matter of <strong>claim<\/strong> of <strong>Thomas E. Owen<\/strong>, now of Capulen, New Mexico, and formerly of Colorado, for loss of <strong>horses<\/strong> and <strong>mule<\/strong> in 1872, by depredations of <strong>Arapahoe Indians<\/strong>, before me, a notary public, in and for the State and county aforesaid, personally appeared <strong>G. W. Thompson<\/strong>, of said county, who, being duly sworn according to law deposes and says: <\/em><\/p>\n<p style=\"text-align: justify;\"><em>That he is personally acquainted with the <strong>claimant<\/strong>, Thomas E. Owen, and has known him over sixteen years.<br \/>\n<\/em><\/p>\n<p style=\"text-align: justify;\"><em>That he knows that in 1872 the claimant owned a fine bay <strong>horse<\/strong> which deponent saw at different times on claimant&#8217;s <strong>ranch<\/strong> in <strong>Colorado<\/strong>, and which, amongst other stock (as the deponent was informed and believes), the claimant had taken from him by <strong>Arapahoe Indians<\/strong> in 1872.<br \/>\n<\/em><\/p>\n<p style=\"text-align: justify;\"><em>The said horse was a bay and aged about seven to nine years in 1872, and in my judgment was worth $250.\u00a0 The horse was an American horse and a good driver.\u00a0 I am a judge of the value of horses, being a <strong>dealer<\/strong> in <strong>livestock<\/strong>, and am at present running a stock farm in Colorado at <strong>Trinidad<\/strong>.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>G.
