notary must meet with the signer to verify <strong>identification<\/strong>, to administer and <strong>oath<\/strong> or <strong>affirmation<\/strong> for a <strong>sworn statement<\/strong>, or to take an <strong>acknowledgment<\/strong> from the signer.<!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Awareness_Willingness\"><\/span>Awareness, Willingness<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The notary must also observe and communicate with the signer to make a lay person&#8217;s judgment that the signer has adequate mental <strong>awareness<\/strong> to <strong>knowingly<\/strong> understand the <strong>purpose<\/strong> of the document.\u00a0 The notary must also conclude that the signer is signing <strong>willingly<\/strong>, without any <strong>undue influence<\/strong> caused by coercion, <strong>duress<\/strong> or the effects of drugs or alcohol.<\/p>\n<p style=\"text-align: justify;\">Physical presence is required to allow the notary to observe the signer face to face to reduce the likelihood of <strong>fraud<\/strong> in the transaction.\u00a0 In addition to <strong>verbal communication<\/strong>, the notary may observe <strong>non-verbal communication<\/strong> indicating confusion, fear or nervousness.<\/p>\n<p style=\"text-align: justify;\">Physical presence is required so that the notary can get the <strong>signature<\/strong> and <strong>thumbprint<\/strong> of the signer in the <strong>notary journal<\/strong>.<\/p>\n<p style=\"text-align: justify;\">For an <strong>acknowledgment<\/strong>, the signer may sign the document before meeting with the notary, but it is <strong>best practice<\/strong> to sign in front of the notary.\u00a0 For an <strong>oath<\/strong> or <strong>affirmation<\/strong>, the signer must make a <strong>sworn statement<\/strong> before the notary and must sign before the notary.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Electronic_notarization\"><\/span>Electronic notarization<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Electronic notarization<\/strong> is available in Colorado, but it is only used when there are electronic documents, rather than paper documents.\u00a0 Electronic notarization does not mean <strong>remote notarization<\/strong>.\u00a0 Physical presence with the notary is required for electronic notarization.<\/p>\n<p style=\"text-align: justify;\"><strong>Colorado Notary
