The words clear and legible are not used.\u00a0 No notary stamp correction instructions are provided in the Colorado Notary Handbook or on the Secretary of State website.<\/p>\n<p style=\"text-align: justify;\">What if the notary stamp impression is not <strong>clear<\/strong> and <strong>legible<\/strong> on the document?<!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Reasons_for_Illegible_Notary_Stamp\"><\/span>Reasons for Illegible Notary Stamp<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Colorado notary law<\/strong> does not specify the procedure for adding a clear and legible <strong>second stamp<\/strong> if the <strong>first stamp<\/strong> impression is <strong>illegible<\/strong>.\u00a0 Problems may occur if the stamp is <strong>smeared<\/strong>, blurred or smudged due to movement, has <strong>unreadable portions<\/strong> caused by not stamping on a hard, <strong>flat surface<\/strong>, has missing or <strong>faint portions<\/strong> due to the inkpad <strong>drying out<\/strong>, has too much ink that obscures the stamp impression, or a <strong>stamp malfunction<\/strong> due to a mechanical problem.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Water-Based_Ink_versus_Solvent_Ink\"><\/span>Water-Based Ink versus Solvent Ink<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Most <strong>self-inking<\/strong> stamps use <strong>water-based ink<\/strong>.\u00a0 If the document is damp, or rain or water gets on the document, the <strong>ink may run<\/strong> and become <strong>blurry<\/strong>.\u00a0 Also, water-based ink will <strong>smear<\/strong> if used on a plastic or <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/how-to-notarize-a-mylar-document\/\" target=\"_blank\" rel=\"noopener noreferrer\">Mylar\u00ae document<\/a><\/strong><\/span> with a smooth surface.<\/p>\n<p style=\"text-align: justify;\">For stamping on a smooth, <strong>non-porous surface<\/strong>, special <strong>industrial ink<\/strong> must be used.\u00a0 One popular brand name, available at a hobby store or Walmart\u00ae, is <strong>StazOn\u00ae<\/strong> <strong>solvent ink<\/strong>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Model_Notary_Act_Illegible_Notary_Stamp_Correction_Procedure\"><\/span>Model Notary Act, Illegible Notary Stamp Correction Procedure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The <strong>2010 Model Notary Act<\/strong>, published by the <strong>National Notary Association\u00ae<\/strong> (<strong>NNA\u00ae<\/strong>) describes a procedure for correcting an <strong>illegible stamp<\/strong> impression.\u00a0 <strong>Section 8-3(b)<\/strong> states: <strong>Illegible information<\/strong> within a seal impression may be typed or printed legibly by the notary adjacent to, but not within, the impression or <strong>another impression<\/strong> may be legibly affixed nearby.<\/p>\n<p style=\"text-align: justify;\">The <strong>Model Notary Act<\/strong> authorizes notaries to remedy <strong>unreadable portions<\/strong> of the stamp by typing or printing the needed wording legibly, adjacent to the seal image.<\/p>\n<p style=\"text-align: justify;\">To avoid claims that the stamp impression was <strong>tampered<\/strong> with, notaries must not write over any portion of the stamp nor make any marks within the area circumscribed by the stamp border.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Notary_Regulator_FAQ_Correction_Procedure\"><\/span>Notary Regulator FAQ Correction Procedure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Several states, including Massachusetts and Minnesota, include a <strong>correction procedure<\/strong> in the FAQ section of the <strong>notary regulator<\/strong> website.<\/p>\n<p style=\"text-align: justify;\">If there is room, affix a <strong>second stamp<\/strong> impression nearby.\u00a0 It is not necessary to cross out the <strong>original stamp<\/strong> impression or write an explanation on the document.\u00a0 The reason for the second stamp will be obvious.<\/p>\n<p style=\"text-align: justify;\">If there is no room for a second stamp, attach a <strong>separate notary certificate<\/strong> with the same wording, signature and a clear and legible stamp.\u00a0 Line through the original notarial wording and draw a line specifically through your seal and signature.\u00a0 Near the old certificate wording, write &#8220;See Attached Certificate&#8221;.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Stamp_Correction_Procedure_from_Notary_Best_Practices_Handbook\"><\/span>Stamp Correction Procedure from Notary Best Practices Handbook<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Michael Closen<\/strong>, a notary law professor, speaker and author, states in his handbook, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/professor-closens-notary-best-practices-guide-book\/\" target=\"_blank\" rel=\"noopener noreferrer\">Professor Closen&#8217;s Notary Best Practices<\/a><\/strong><\/span>, section 8.5:<br \/>\n1. if possible, print another copy of the page, re-execute the page, and shred the defective copy, or<br \/>\n2. strike out the defective stamp impression with a line or an X through it, add the notary&#8217;s initials and date, then add a second legible stamp impression on the notarial certificate<\/p>\n<p style=\"text-align: justify;\">The notary should not attempt to correct a faulty stamp impression by making a handwritten correction or modification of the existing faulty image.<\/p>\n<p style=\"text-align: justify;\">The notary should make a note in the notary journal entry explaining how the defective seal impression was corrected.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Use_a_Small_Size_Notary_Stamp\"><\/span>Use a Small Size Notary Stamp<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Colorado law does not specify the <strong>size<\/strong> or <strong>ink color<\/strong> for the notary stamp.\u00a0 It must be rectangular.<\/p>\n<p style=\"text-align: justify;\">Using a <strong>small size<\/strong> <strong>notary stamp<\/strong> will allow more room to stamp the document a second time if needed.\u00a0 A <strong>large size notary stamp<\/strong> may use up all available space so there is no room to stamp a second time.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Stamping_Skill_Improves_With_Practice\"><\/span>Stamping Skill Improves With Practice<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">With practice, a notary should be able to make a clear stamp impression on a regular basis.\u00a0 It may be helpful to make a test stamp on a blank piece of paper before stamping the signed document.<\/p>\n<p style=\"text-align: justify;\">A <strong>clipboard<\/strong> is useful to provide a flat surface for signing and stamping.\u00a0 The rubber stamp may need occasional <strong>cleaning<\/strong> to remove <strong>ink residue<\/strong>.\u00a0 When a stamp impression is illegible, be prepared to make a
