\"Saint<\/a>Notaries and the Church<\/h1>\n

The history of the notary public<\/strong> is closely related to the early Catholic Church<\/strong>.\u00a0 Tiro<\/strong>, a secretary for the orator and statesman Cicero<\/strong> in Ancient Rome<\/strong>, developed a shorthand<\/strong> system named nota<\/strong>, used by the Roman notarius<\/strong>, or notary. The Romans used notaries in lands they conquered.<\/p>\n

The Church developed its own system of notaries, especially following the decline of the Roman Empire<\/strong>.<\/p>\n

<\/span>Pope Clement I<\/span><\/h2>\n

Notaries were officers of the Catholic Church<\/strong> from an early time.\u00a0 Pope Clement I<\/strong>, the fourth Pope, appointed notaries in Rome to record the acts of any martyrs.\u00a0 Later, the Church claimed that papal notaries<\/strong>, appointed by the Pope, had international jurisdiction<\/strong> and could act in any country.<\/p>\n

As the Roman Empire<\/strong> started to decline, near the end of the second century, the power of the Pope increased, and took the place of the Roman Emperors.\u00a0 The Church took over many functions previously performed by the government<\/strong>.<\/p>\n

<\/span>Pope Leo III and Charlemagne<\/span><\/h2>\n

During the eighth century, the Holy Roman Empire<\/strong> was created in central Europe.\u00a0 In 800 AD, Pope Leo III<\/strong> crowned Charlemagne<\/strong> as the emperor.\u00a0 Charlemagne and emperors who followed claimed all the authority of the previous Roman emperors.\u00a0 This included the authority to appoint imperial notaries<\/strong> who had jurisdiction in any country that was once part of the Roman Empire.\u00a0 Bishops<\/strong>, abbots, and counts were required to have their own notaries.<\/p>\n

For administrative convenience, the Pope<\/strong> frequently delegated the authority to appoint notaries to religious leaders, usually Archbishops<\/strong>, and other leaders.<\/p>\n

\"Medieval<\/a>Imperial and papal notaries<\/strong> in England<\/strong> did work for ecclesiastical courts<\/strong> and in commercial transactions<\/strong> with foreign countries.\u00a0 They added a unique graphic sign<\/strong> which identified the notary<\/strong> who prepared the document.\u00a0 Some also included an inscription using Tironian notes<\/strong>.<\/p>\n

Notaries retained copies<\/strong> of documents they issued.\u00a0 If the originals were lost, notaries could reissue documents from their own records.\u00a0 In the 16th<\/sup> century, the creation of public notarial archives<\/strong> became popular as a central storage location.<\/p>\n

<\/span>Pope Sixtus V<\/span><\/h2>\n

\"Pope<\/a>Pope Sixtus V<\/strong>, became aware of record keeping<\/strong> methods used in several locations, including the Medici<\/strong> of Florence<\/strong>, and other states, including Spain<\/strong>.\u00a0 In 1588, he refashioned notarial record keeping practices.\u00a0 Well-ordered archives<\/strong> hindered fraud<\/strong>, protected commerce, and helped to guarantee justice<\/strong> and protect contracts, a mark of good and effective government<\/strong>.<\/p>\n

Laws<\/strong> (bandi) were written requiring communities to provide proper document storage<\/strong> facilities, keep document inventory lists, and to choose an archivist<\/strong>.\u00a0 Income received by the archivist contributed to the community\u2019s annual tribute<\/strong> to the papal treasury<\/strong>.<\/p>\n

<\/span>Pope Clement VII and King Henry VIII<\/span><\/h2>\n

\"Coat<\/a>King Henry VIII<\/strong>, a devout Catholic, had a dispute with Pope Clement VII<\/strong>, and got Parliament to give the power to appoint bishops<\/strong> in England without the Pope\u2019s permission.\u00a0 The Pope excommunicated the King.<\/p>\n

In 1534, Henry VIII<\/strong> then got Parliament to make him the head of the Church of England<\/strong>, including the power to appoint notaries, which was delegated to the Court of Faculties<\/strong>, under the Archbishop of Canterbury<\/strong>.\u00a0 The Reformation<\/strong> reduced the power of ecclesiastical law<\/strong>, and common law<\/strong> became the supreme law in England<\/strong>.<\/p>\n

There are ecclesiastical notaries<\/strong> in the Church today, who deal with religious matters<\/strong> under canon law.<\/strong><\/p>\n
