The <strong>Uniform Law Commission<\/strong> (<strong>ULC<\/strong>) has written the <strong>Uniform Fiduciary Access to Digital Assets Act<\/strong> (<strong>UFADAA<\/strong>) as model language for states to use, rather than writing new laws.\u00a0 <strong>Delaware<\/strong> was the first state to pass a comprehensive digital assets act in July 2014.\u00a0 Some other states have passed limited laws.<\/p>\n<p style=\"text-align: justify;\">In 2016, <strong>Colorado <\/strong>enacted the <strong>Revised Uniform Fiduciary Access to Digital Assets Act<\/strong>, (<strong>RUFADAA<\/strong>), found at CRS 15-1-1501.\u00a0 Other states are also adopting RUFADAA.\u00a0 Check the status of new legislation on your state legislature website.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Service_Provider_License_Agreements\"><\/span>Service Provider License Agreements<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Some service providers have user <strong>license agreements<\/strong> that state there is no <strong>right of survivorship<\/strong> or <strong>transferability<\/strong> or multiple user access for an online account.\u00a0 They may have the right to delete the user account when they are notified of the user&#8217;s death, by receiving a certified copy of a <strong>death certificate<\/strong>.\u00a0 Or, an account may be deleted or inactivated after a period of <strong>inactivity<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>Service providers<\/strong> may also specify a <strong>choice of law<\/strong> provision, that the user agreement will be under the <strong>jurisdiction<\/strong> of the state where the service provider is located, although the user may reside in another state with different laws.\u00a0 This issue also needs to be addressed in state laws to allow a <strong>fiduciary<\/strong> to perform authorized duties on behalf of the <strong>principal<\/strong>.<\/p>\n<p style=\"text-align: justify;\">If an account is deleted, family members and advisors may lose <strong>valuable records<\/strong> and information needed to analyze and wind down the affairs to settle the <strong>estate<\/strong> of a deceased loved one or client.<\/p>\n<p style=\"text-align: justify;\">State laws are being written to give rights to fiduciaries to gain authorized access to user accounts, so the <strong>fiduciary<\/strong> can act on behalf of a <strong>principal<\/strong> who is deceased or incapacitated.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Sample_Power_of_Attorney_for_Digital_Assets\"><\/span>Sample Power of Attorney for Digital Assets<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A sample <strong>Power of Attorney<\/strong> is available for download below.\u00a0 The sample form grants power to the <strong>designated agent<\/strong>, and potential successor agents, to deal with the assets on behalf of the principal.<\/p>\n<p style=\"text-align: justify;\">Other documents are needed to include digital assets in a <strong>last will and testament<\/strong>, for final disposition by an <strong>executor<\/strong> or <strong>personal representative<\/strong>, or in a <strong>digital asset trust<\/strong>, for <strong>digital asset management<\/strong> and disposition by a <strong>trustee<\/strong>, or for a <strong>custodian<\/strong> or <strong>guardian<\/strong> agreement.<\/p>\n<p style=\"text-align: justify;\">A power of attorney terminates upon the <strong>death<\/strong> of the <strong>principal<\/strong>, or when it is <strong>revoked<\/strong>, so a last will or trust is needed to deal with these assets after the death of the principal.\u00a0 A power of attorney can be <strong>durable<\/strong>, continuing in effect during the disability or incapacity of the principal.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Beneficiary_Agreement\"><\/span>Beneficiary Agreement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A <strong>beneficiary agreement<\/strong> may be used to transfer account access and assets to a designated <strong>beneficiary<\/strong> upon the death or incapacity of the principal.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Digital_Assets_Inventory\"><\/span>Digital Assets Inventory<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The sample POA form grants power to the agent to use digital devices, access assets, and manage files and accounts of the principal.\u00a0 A separate <strong>Letter of Instructions for Digital Assets<\/strong> or <strong>Digital Assets Inventory<\/strong> lists details needed by the agent, such as account numbers, email accounts, websites, user names, passwords, security codes, answers to security questions, etc.\u00a0 The list needs to be updated when information changes.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Password_Security\"><\/span>Password Security<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">For <strong>security<\/strong>, do not list the <strong>passwords<\/strong> on the same paper or computer file with the rest of the account information.\u00a0 Passwords may be kept in a separate secure file, protected by a strong password, or in a <strong>fireproof safe<\/strong>, safe deposit box, attorney&#8217;s office, or <strong>password manager<\/strong> such as <strong>LastPass\u00ae<\/strong>, using <strong>two-factor authentication<\/strong>.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Resources\"><\/span><strong>Resources<\/strong>:<span
