In <a href=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-204\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/2014\/01\/Colorado_Notary_Law_120x80.jpg\" alt=\"Colorado Notary Law\" width=\"120\" height=\"80\" \/><\/a>Colorado, a notary public is a public official commissioned by the Secretary of State to notarize (authenticate) signatures on legal documents.\u00a0 The primary role of the notary is to deter <strong>fraud<\/strong>.<!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"No_Legal_Advice\"><\/span>No Legal Advice<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">A Colorado notary is not required to have a law degree or <strong>legal training<\/strong> as an attorney or paralegal.\u00a0\u00a0 Since May 2010, notaries must complete a <strong>Colorado Notary Training<\/strong> course and pass the <strong>Colorado Notary exam<\/strong>. A Colorado Notary may have acquired legal knowledge by reading, attending legal courses, job experience or life experience.\u00a0 But, the notary may not offer <strong>legal advice<\/strong>, specific to a customer&#8217;s situation, unless the notary is also <strong>licensed to practice law<\/strong> in Colorado.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Notario\"><\/span>Notario<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Some unethical notaries who speak <strong>Spanish<\/strong> may advertise their services as a <strong>notario<\/strong> or notario publico, to attract business from customers who are not fluent in English.\u00a0 The customer may incorrectly assume that a Colorado notary public is the same as a notario publico in their native country.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Deceptive_Advertising\"><\/span>Deceptive Advertising<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The most frequent area for <strong>deceptive advertising<\/strong> by these notaries is for <strong>immigration consulting<\/strong>.\u00a0 If the notary exceeds their authority as defined by notary statutes, they may be engaged in the <strong>Unauthorized Practice of Law<\/strong> (UPL).<\/p>\n<p style=\"text-align: justify;\">To prevent deception and confusion, <strong>Colorado law<\/strong> CRS 12-55-110.3 makes it <strong>illegal<\/strong> for a notary to advertise their services as a notario or notario publico, unless the notary is licensed to practice law in Colorado.\u00a0 While the emphasis is on <strong>Spanish speaking notaries<\/strong>, the law also applies to notaries advertising in other <strong>foreign languages<\/strong>.<\/p>\n<h2 style=\"text-align: justify;\">Disclaimer<\/h2>\n<p style=\"text-align: justify;\">When\u00a0advertising in a foreign language, including signs, the following notice must be included in English and the foreign language:<\/p>\n<p style=\"text-align: justify;\"><strong>I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN THE STATE OF COLORADO AND I MAY NOT GIVE LEGAL ADVICE OR ACCEPT FEES FOR LEGAL ADVICE.<\/strong><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Fee_Schedule\"><\/span>Fee Schedule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The notary must also post a <strong>list of the fees<\/strong> allowed by law for notary services, written in English and the foreign language.<\/p>\n<p style=\"text-align: justify;\">Notaries that speak Spanish or other foreign languages can provide a useful service to assist customers.\u00a0 But, they must not advertise as a notario or provide legal advice unless they are licensed to practice law.<\/p>\n<p style=\"text-align: justify;\">Contact us for <a href=\"https:\/\/abclegaldocs.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Colorado Springs Mobile Notary<\/strong><\/a> service or <a href=\"https:\/\/abclegaldocs.com\/Colorado_Notary_Training.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Colorado Notary Training<\/strong><\/a>.<\/p>\n<p style=\"text-align: justify;\">\u00a9 Copyright 2013 ABC Legal Docs, LLC All rights reserved.
